dRTICLE VIII. <br />Distribution of VY�.ter. , <br />8ection 1--Liability of the Companyc-�Phe company �hall <br />no't be coneidered for any purpose ae guaranteeing to the holdere <br />of stoak the use at any or e11 timee of the Y�}11 amount of xater <br />to which they are respectively entitled; end if, in the distri- <br />bution of water eny etockholder me,y at any time f ail to receive <br />his, her, or ite proportionate ehare, the company ehall not be <br />liable to such etockholder in damages, if such failure be cd.used <br />by an error in �udgment on the pert of those charged with the <br />dietribution of water, by reaeon of the fact that euffioient water <br />be not available to the extent that each stockholder could receive <br />the share of �vater to r+hich he is entitled, or by reaeon oi any <br />fact, thing� or circumetance beyond the control of euch person; <br />but the company ehall�only be liable in damages to euch etock- <br />holder in caso euch f ailura to dietribute water equally wae the <br />result of some rrilful discrimination against euch atockholder on <br />the part of the Board of Directore or oi thoee charged by the <br />Board of Direotore with the dietribution of water. <br />8ection 2--Waeting VJater--No stockholder ehall ba per- <br />mitted to waete �e.ter; and in caee of any euch waete, the Hoard <br />of Direotore ehall heve, and ie hereby given authority to taka <br />such etope or uee suoh meadures ae it deema neceseary to prevent <br />future naeLe and to punieh euch maeting of water as h�e thereto- <br />fore occurred. � <br />Bection 3--Delivery to Lateral Head Gates--The point <br />of dietribution and delivery of water by the company to the re- <br />spective etockholdere ehall be on the main ditch at the head <br />gates of the �espective laterale throu�h r�hich they receive <br />their respective amounte of water.
