Recor.struction or re-routing of a portion of the ditch (the latter <br />would also e~tail a new easernent or special use permit). <br />5. Pesticides may not be used to cantrol undesirable woody and herbaceous <br />veqetation, aquat~c plants, insects, rodents, trash fish, etc., without the prior <br />written approval of the Eorest Service. A rec~zest for approval of planned uses of <br />pesticides will be submitted annually by the holder on the due date established hy <br />the authorized officer. ~he xe~ort ~ill ccver a 12-month period of planned use <br />beqinning 3 months after the reporting date. Information essential for review will <br />be provided in the fo~-m specified. Exc~ptions to this schedule may be allowed, <br />subject to emergency request and approval, on].y when unexpected outbreaks of pests <br />requize control measur2s which were not ~nticipated at the time an annual report <br />was submitted. Only thase ma~erials ragistered by the U.S. Env~ronmental <br />Protection Agency for the specific purpose planned will be considered for use on <br />National Forest System lands. Label instructions S~ill be strictly followed in the <br />applicatian of pesticides and disposal of excess materials and containers. <br />6. The holder shall be responsible £or the prevention and control of noxious weeds <br />and/or exotic plants of concern on the area authorized by this authoriza~"ion and <br />shall provide prevention and control measures prescribed by tY~e Forest Service. <br />Noxious weeds and exotic plants of concern are defi~ed as those species recognized <br />by the White River National Forest in which the authorized use is located. When <br />determined to be necessary by the authorized o~~ic~r, the holder sha11 develop a <br />site-speciaic plan for noxious weed and exatic~plant pxevention and control. Such <br />plan shall be subject to Forest Service approval. Upon Forest Service approval, <br />the noxious vreed and exotic plant pr~vent~on and ccn~rol plan sha11 become a part <br />of this authorization, and its provisions shall be enforceable under the terms of <br />this authorization. <br />7. Only hay, grain, atraw, cu~es or mulch certified as noxious weed free or noxious <br />weed seed free by an authorized S~ate Department of Agriculture official or <br />designated county official rnay be used. Each indiaidual bale or container must be <br />tagged or Xnarked as a certified weed free product and reference a written <br />certification, iz one exists. <br />8. Description of existing facilies: This permit covers approximately 31 acres <br />associated with the L.E.D.E. Reservoir and dam, and approximately 2600 lineal feet <br />{0.53 miles) associated with the L.E.D.E. Ditch, located within Sections 2, 9 and <br />16, T. 7 S., R. 84 W., 6t'' P.M., as shown or~ Exhibits A, B and C, attached to and <br />made a part of tha.~ permit, and is l.ssued for the purpose of: accessing, operating <br />and maintaining the L.E.D.E. Reservoir and dam (darn ia approximately 430' long by <br />46` wide and a spillway 200' by 30'} and L,E.D.E. Ditch, as described on Exhibits <br />A, B and C hereto. The access to L.E.D.E. Ditch from L.E.D.E. Reservoir is <br />approximately 5000 lineal feet or 1.13 tniles and is a1sQ shown on the attached <br />Exhi.bit C. <br />
