The names of those individuals responsible for activating the plan and carry~ng out the identified <br />actions, <br />In preparing the smergency action plan, the holder shall consult and cooperate with appropt'iate Eaw enforcerr-ent <br />and civii preparedness personnei, who may be responsib~e for implementir-g all or part of the plan. Emergency <br />action plans shall be reviewed and updated annually, and tested at intervals not exceeding five years. <br />6. lnspection and Maintenance of Dams. <br />The holder shall have the dam and appurtenant structur~s inspected by a qua[ified engineer to deterrnine the <br />state af operatlon and maintenance at least eve~v two vears. An inspection shall also be made following <br />earthquakes, major storms, or overflow of spillways other than the service spillway. Two copies of the inspection <br />report shall be provided to the authorized officer wi#hin 30 days of the date of inspection, <br />Repairs or operational changes recornmended by the inspecting enginesr shall be made by the holder within a <br />reasonable periai of time following the inspection, but in no event later than one year frorn the inspection (unless <br />a longer period of repairs is authorized in writing, or a shorter period is required when such repairs are deemed by <br />t~e authorized offcer as immediately required ior reasons of public safetj+). Upon request by the authorized <br />officer, the halder shaH provide a plan o€ action outlining planned time and rneth~ds for per~arming said repairs or <br />operational changes, and notify fhe authorized officer when actions are completed. The authorized ofhcer shall <br />specify a compfetion date for coRective work. If corrective acfson is not ta[cen by the date.specified by the <br />autharized officer, fhe Forest Service shall have carrective action taken and the holder shall be responsible far al! <br />costs including legal and court costs. <br />7. Forest Service lnspection of Dams. <br />The holder shall alfow inspection af the dam and appurtenant structures af any time by the aut~orized ~fficer. Any <br />candition adversely affecting or which could adversely affect the operation of the facility; safety of the structure or <br />the public, or surrounding lands and resources shall, upon wriEten notice, be correc#ed ar changed by the holder <br />at the holder's expense. The authorized o~cer shall specify a completion date ior correcH~e wark. If corrective <br />action is not taken by the dat~ spe~3fied by the auf~orized officer, the Forest Service shall have corrective action <br />taken and tl~e holder shall be responsible for a[l casts including legal and court costs. A copy of the Forest <br />Service inspection report shall be provided to the nolder. An inspection performed by the Forest Service does nat <br />relieve the holder of the responsibifity of ensuring thaf inspections are made in accardance with sec6on 6 of this <br />c[ause. <br />8. Dam Safety Evaluakions, <br />This provision is required for certain hazard classifications identified in section 2. <br />Beginning in 20Q6 and at 5-year infervals thereafter, the halder shall have a formal dam safety evaluation <br />performed by a qualified engineer to verify the safety and integrity of the dam and aQpurtenant structures. The <br />evaluation wilf include, but is not limited to, a detailed field inspection of the dam and appur~enant structures and a <br />review of all pertlnent documents, such as investigation, design, construction, instrumentation, operation, <br />maintenance, and inspection records. The evaluation shall be based on current accepfied design criteria and <br />practices. The holder shall provide fwo copies of the evaluation reporE to the authorized officer and Regional <br />Engineer, Based on this reporE, the autF~orized officer may require the holder to perform additiona! evaEuations <br />pu~suant ta such standards as the officer may define and may require rehabilitation or modification of the <br />structure within a reasonable time. <br />9. Right of Actlon To Abate Emergen~y Situations. <br />In situations where the authori~ed officer determines on the available facts that there is danger of a dam failure for <br />any reason, such ofFicer may exercise discretionary authority to enter upon the structure and appur~enances <br />authorized herein and take such actions as are necessary to abate or othen+vise prevent a failure. Such actions <br />include, but are not limited to, lowering the level of the impounded waters utilizing existing structures or by <br />artificial breach of the dam. ln the eve~t that such actions are taken, the iJnited States shall naE indemnify or ~ <br />otherwise be liabie #o the holder for ]osses or damages, including losses or damages ta the structure or the value <br />of impaunded waters.
