11) While the application and decree for Old Dillon Reservoir First Enlargement <br />(Case No. 93CW288) clearly describes a 150 acre-foot enlargement there may <br />be different interpretations of how the rights decreed in Case No. 93CW288 can <br />be stored in the Old Di11on Reservoir First Enlargement. The River District <br />leaves these legal issues to be resolved by Summit County and the towns. The <br />objectives of the parties must be clearly defined before ways of ineeting those <br />objectives can be described and evaluated. <br />2.2 Project Sponsor <br />The project sponsor is the Town of Dillon, Colorado. The Town was incorpoxated on <br />January 26, 1883. The Town of Dillon has moved three times with the final move in 1956 <br />when the DenveY Water Board began the pYOCess of building the dam. The residents moved <br />to Dillon's final location on the shores o£ Dillon Reservoir in 1961. Dillon is located south of <br />InteYState 70, 70 miles west of Denver in Suinmit County. Dillon is a small community with a <br />population just oveY 800. Eighty percent (80%) of the housing units ~e second homes which <br />incxeases the population to appro~mately 5,000 in the peak seasons. <br />The service area is the Town boundaxies with two exceptions for providing watex service to <br />locations just outside the Town limits: the United States Forest Service pxoperty on County <br />Road 51 and the Town of Silverthorne attainable housing project on West Anemone (see 1-Ylater <br />Seruice Area, Exhibit L). The total customer base of 428 is a mix of xesidential, multi-family <br />xesidenrial and commexcial uses. The cuxrent water usage is approximately.99 ~ lion gallons =~d°~ ~a~ <br />per yeaY based on 2008 usage. The capacity in the state of the art watex membrane treatment <br />plant is 547.5 inillion gallons peY year. <br />Revenues are provided fxom customers through the monthly volume chaxge and monthly <br />capital fee. The 2009 xates are as follows: ,~~ cp~po~ <br />.X ~~~ a~ <br />Monthly Volume Chaxge $17.00 per EQR •~' <br />Monthly Capital Fee $ 3.00 per 1,000 gallons for usage 15,000 gallons and less <br />$ 4.50 pex 1,000 gallons for usage over 16,000 gallons <br />One EQR is equivalent to a three bedroom, three bathroom single family home. An EQR <br />schedule deteYxnines the number of EQRS foY other uses (see EQK Schedule, Exhibit MJ. The <br />Town is limited in growth by the capacity in the sewer treatment plant of 2,100 EQRs. The <br />Town currently has 1,695 EQRs on line or 81% of buildout capacity. Tap fees are also <br />collected for new construction, remodels and change of uses that affect the numbex of EQRs <br />associated with the pxopeYty. The 2009 water tap fee rate is $7,000 per EQR. <br />The Town's main souxce of raw water comes fxom Straight Creek. This souYCe is highly <br />susceptible to contamination from forest fires and hazardous materials from I 70. The water <br />is diverted fYOm the creek approximately one mile upstream from the watex plant. The <br />Town's watex system is comprised of a 1.5 MGD microfiltration treatment plant, two water <br />storage tanks totaling 0.9 MG of treated storage, gravity fed distribution system, and an <br />emergency connect with two suYxounding communities. <br />7 <br />
