6) directly downstream of Old Dillon Reservoir or upstream by exchange in the <br />Blue River, Snake River or Ten Mile Creek as exchange potential exists. <br />7) Silverthorne's water rights which can be used in Old Dillon Reservoir First <br />Enlargement may be usable directly or by exchange. <br />8) The Town of Dillon's rights in existing or enlarged Old Dillon Reservoir or the <br />Dillon Ditch can be used in three ways, directly, through alternate points of <br />diversion, or by exchange. <br />a) Directly: <br />i) Routing of Old Dillon Reservoir, Old Dillon Reservoir First <br />Enlargement and Dillon Ditch water to the Town of Dillon across <br />Denver Water's Dillon Reservoir (water bridge concept) can be <br />achieved by rebuilding the outlet from Old Dillon Reservoir to Dillon <br />Reservoir and picking up the water from the shore of Dillon Reservoir <br />in the Town of Dillon. <br />b) By exchange: ' <br />i) The Town of Dillon's Old Dillon Reservoir water rights could also be <br />used by exchange at the Town of Dillon's Dillon Blue River Intakel l as <br />contemplated in the decree in Case No. 86CW330 by releases down Salt <br />Lick Gulch to the Blue River. <br />ii) To utilize Dillon's rights in Old Dillon Reservoir by exchange to <br />Dillon's Straight Creek Diversion, Dillon's wells, or Silverthorne's <br />wells the potential out-of-priority divertable flow available to Dillon <br />from Straight Creek or the wells, would be replaced by releases of water <br />from Old Dillon Reservoir to the Blue River or to Dillon Reservoir. <br />These exchanges are described in the application and decree in Case No. <br />87CW392.12 <br />c) Through Alternate Points of Diversion <br />i) The rights in the Dillon Ditch could be used through alternate points of <br />diversion at the Town of Dillon's Straight Creek Diversion, the Dillon <br />Blue River Intake or the Town of Dillon's wells. In any case, <br />adjudication of any alternate points of diversion would be required. <br />9) Administrative process can likely be achieved, including an agreement on the <br />operation of Old Dillon Reservoir and Old Dillon Reservoir First Enlargement; <br />accounting of uses of water from Old Dillon Reservoir First Enlargement; right- <br />of-way needs for the construction of infrastructure; permits secured; and <br />exchange plans and alternate points of diversion for use of Old Dillon Reservoir <br />and Old Dillon Reservoir First Enlargement or Dillon Ditch water above Salt <br />Lick Gulch. <br />10) The physical water supply from Salt Lick Gulch far exceeds the decreed <br />interests in Old Dillon Reservoir in Case No. C.A. 1806 and Old Dillon <br />Reservoir First Enlargement described in Case No. 93CW288. Consideration of <br />larger objectives, recognizing the many limitations on the use of this water <br />supply, are possible. <br />~ - - _ <br />..e - - <br />6 <br />
