need to find an altexnative water supply. This project will impxove the utility of Old Dillon <br />Reservoir as an alternarive water supply foY the Town of Dillon, thereby increasing the watex <br />supply security fox the town. <br />A 1992 Water User Agreement and Special Warranty Deed (.ree 1~ater Agreement, Exhibit C) <br />between Suminit County and the Town of Dillon conveys to Summit County the right to <br />enlarge the reservoir, with the Town of Dillon able to parricipate in the enlargement up to <br />20% and pxovides to the Town of Dillon 39 acre-feet of watex identified in the "Denver <br />Subordination". Use of this wateY requites the Town of Dillon to provide replacement watex <br />to DenveY Water. The existing pool in Old Dillon Reservoir is idenrified in the Denver <br />suboxdination agxeement as a potential source of xeplacement wateY. The Special Waxranty <br />Deed grants Sumnut County 8 cfs of the 10 cfs water right for the Dillon Ditch granted in CA <br />1806. In the absence of the availability of ox ability to divert the full 10 cfs the Town of <br />Dillon has the right to take 1/5 of the available wateY and Suinmit County 4/5. <br />The Town of Dillon and Suininit Counry vutiated studies on the feasibility of enlarging Old <br />Dillon ReservoiY in 1995. In 2004 the County and Dillon solicited the assistance of the <br />Colorado River Water Conservarion District to make the enlaYgement a Yeality. The Town of <br />SilvexthoYne was invited to participate in the enlaxgement by Suininit Counry. The three <br />entities entered into an IGA to formalize the process (.ree Old Dillon Keseruoir Con.rortium <br />Intergovernmental Agreement, Exhibit D). <br />Old Dillon Reservoir was established as a 46 acxe-foot xaw water storage reservoir fed by the <br />Dillon Ditch, which diverts from Salt Lick Gulch. The Dillon Ditch and ODR were <br />constructed in 1939 befoYe these lands wexe designated paxt of the NFS. Old Dillon <br />Reservoir and a portion of the Dillon Ditch axe claimed by the Town of Dillon as a potentially <br />valid outstanding right (PVOR) on Fedexal lands (see USFS Kecognition of PVOK, Exhibit E), <br />affecting approxirriately 14.5 acres within the WRNF. The draft scope of right document is <br />currently under review by the USFS. The Dillon Ditch is operated and maintained by the <br />Town of Dillon under special use authorization DIL 199 issued on January 13, 2003. <br />~~ <br />The project includes five elements: !~(p <br />1) enlaxging the existing xeservoix fromfr2'acre-feet (AF) to 286 acre-feet; <br />2) xestoxing the outlet from ODR to the south to the Blue River (now Dillon Reservoir); 3) <br />rehabilitarion and modification of Dillon Ditch and its headgate on Salt Lick Gulch to serve <br />_ the enlaxged reservoir; <br />4) xehabilitating the oudet to Salt Lick Gulch; and, <br />5) tempoYary road access improvements. <br />Appxo~tnately 20 acres will be impacted by the reservoir enlaYgement, the Dillon Ditch <br />improvements and the rehabilitation of the oudet to the Blue River to the south of Old Dillon <br />Reservoir. Also proposed at the reservoir is the creation of lacustrine wetlands (Bxinson 1995) <br />to compensate foY wetland impacts deYived from the project. The wetlands would be <br />constructed on the northeast and southwest shorelines of the xeservoir. The e~sting <br />recxearional trails in the project aYea axound the shoreline of ODR would be reconstructed. <br />~ <br />2 <br />
