Henrylyn Irrigation District Agenda Item 15a <br />July 11-12, 2007 <br />revenue laws pertaining to the assessment, levying, and collection of property taxes (including <br />enforcement of penalties and forfeiture for delinquent taxes) are applicable to HID. The HID may <br />also refuse delivery of water to lands until all past due or delinquent assessments have been paid in <br />full. Because this loan contract exceeds $400,000, the Irrigation District Law of 1905 requires the <br />HID to hold a special election of the legal electors in the district to authorize and ratify the contract. <br />C.R.S. 37-41-113(4). The election must follow the same procedures that the district would follow to <br />authorize the issuance of a bond. (C.R.S. 37-41-117.) <br />Water Riqhts <br />The HID owns 123 shares (or 5.8%) in the Burlington Ditch, Reservoir and Land Company, and <br />2,759.147 shares (or 20.30%) in the Farmers Reservoir and Irrigation Company's (FRICO), Barr <br />Lake Division. In addition, HID has decrees for diverting through the Burlington Canal headgate, <br />for the Denver-Hudson Canal, 300 cfs, with appropriation date of 11/28/1907 and adjudication date <br />of 11/12/1924; and the South Platte and Sand Creek Diversions, 100 cfs, with appropriation date of <br />8/11976 and adjudication date of 7/10/1989; and the following reservoir decrees: <br /> Storage Appropriation Adjudication <br />Reservoir acre-ft. ($10,097,000) <br />Alternative 1, Naaction a/ternative - This was considered unacceptable for Horse Creek <br />Reservoir since the result of not repairing the outlets and controlling the seepage in the dams would <br />ultimately result in major restrictions on the reservoir storage within 5 years. It was not acceptable <br />for Prospect Reservoir due to the potential for piping failure along the outlet. <br />Alternative 2, Repair critical reservoir dam and outlet works components - This included repair <br />and lining of the outlet conduits, repair of the inlet and autlet structures, and resurfacing the dam <br />crest. For Horse Creek Reservoir, it also included installing toe drains. <br />Alternative 3, Comp/ete rehabilitation of reservoir dam and outlet works - This alternative <br />considered complete rehabilitation of the dams including breaching and replacing the outlet works, <br />applying riprap bedding and riprap to the upstream face of the dam from the dam crest to the <br />upstream toe. In addition, for Horse Creek Reservoir this alternative would include installing toe <br />drains. <br />Selected Alternative 2 Repair critical reservoir dam and outlet works components - <br />Afternative 2 was selected by the HID Board based on cost.
