<br />restrict the potential and reasonable re-
<br />covery of that species; and (3) there
<br />may be masrq kinds of actions which can
<br />be: cara•ted out within the Critical Hab!-
<br />tnt of a species wfiickl would not be ex-
<br />pcctcd to adverse>,y affect that species. In
<br />addition, 1t should be ttoted that the pro-
<br />hibitions of txction 7 apply only to Fcd-
<br />cral agencies.
<br />A Critical HabltaC designation is based
<br />solely on biological factors and serves
<br />only to officially notify Federal agencies
<br />that their r~ponsfbillties under 15ectlon
<br />7 of Lhe Act aro applicable in a Cerialn
<br />area. The impact of specific Federal ru;-
<br />tlons on listed species should be dealt
<br />v:1th after Critical Habitat has been
<br />deslPnated, a.3 they are not relevant to
<br />the biological basis of Critical Habittit
<br />determination. The Service, in coopera-
<br />iton with other Federal agencies, has
<br />drafted guidelines which establish a con-
<br />sultation and assLstance process for suet-
<br />uating tho possible etiects of actions on
<br />tine t ritlcal habitat of listed species in-
<br />volved. PropoFCd regulations for Intera-
<br />[;rncy Cot>peratlon wets published on
<br />January 28, 1977, 1n the F1nERAL IZ.S(:IS-
<br />~ca (42 FR 41368-4875) which will assist
<br />F'ecierrsl agencies in complying wall Sec-
<br />tlan 7 of the Act-when published in final
<br />form.
