<br />State ofTexasp, State of New Mexico, 494 U,S._, 108 L.Ed.2d 98,110 <br />S,Ct. _' Based on the recommendation of the Special Master, the <br />Supreme Court granted the joint motion for entry of stipulated judgment. <br />The stipulated judgment required New Mexico to pay Texas $14 million <br />on or before March 1, 1990; the money will be disbursed by Texas in <br />accordance with Exhibit B of the joint motion. The stipulated judgment <br />also requires Texas to release New Mexico from all claims for equitable or <br />legal relief, other than the relief embodied in the Court's March 28, 1988 <br />Amended Decree and actions thereunder, arising out of New Mexico's <br />breaches of the Pecos River Compact for the years 1952 through 1986. <br />Exhibit B specifies how Texas is to use the $14 million: $13,800,000 will <br />be deposited in Texas Water Assistance Fund No, 480 of the Texas Water <br />Development Board to be used for agricultural and irrigation projects and <br />any necessary associated studies in the Texas counties of Loving, Ward, <br />Reeves, and Pecos; the Texas Attorney General may treat the other <br />$200,000 as attorneys' fees or investigative costs, provided that Texas and <br />New Mexico agree that any use of the settlement funds in this manner will <br />not be construed as an admission that New Mexico has any liability for the <br />attorneys' fees and costs Texas incurred in this litigation. <br /> <br />3. LEGISLATION <br />In the Second Session of the 101st Congress (without regard to the <br />water year), Congress enacted the following statutes that are important to <br />the Upper Colorado River Basin States: <br /> <br />Public Law 101- 514, approved November 5, 1990, Energy and Water <br />Development Appropriations Act, 1991. <br /> <br />Public Law 101-512, approved November 5, 1990, Department of <br />the Interior and Related Agencies Appropriations Act, 1991. <br /> <br />Public Law 101-506, approved November 5, 1990, Rural Develop- <br />ment, Agriculture, and Related Agencies Appropriations Act, 1991. <br /> <br />31 <br />
