<br />" <br /> <br />For a species listed as endangered prior to the 1978 <br />ESA revisions, critical habitat was not necessarily <br />designated, (which is the case with the Colorado <br />endangered fish). While FWS can be petitioned to <br /> <br />designate critical habitat, the Service has inter- <br />preted the ESA as containing no specific procedure. <br />In the one known instance where FWS was petitioned <br /> <br />(by the National Wildlife Federation) under the ESA <br />to designate critical habitat, FWS dismissed the <br />petition and recommended refiling under the Adminis- <br /> <br />trative Procedures Act. <br /> <br />FWS proposed critical habitat for the Colorado squaw <br />fish in the Federal Register just prior to the 1978 <br />amendments. This proposal was withdrawn following <br />the enactment of the revisions in view of the new <br /> <br />statutory language which required FVlS to look at <br />economic impact. Dr. James Williams, Office of <br />Endangered Species, ~lS Washington, believes that the <br /> <br />FWS should designate critical habitat for the Colora- <br />do endangered fish in order to clarify the demands on <br /> <br />Colorado water users. <br /> <br />-33- <br />
