The end - of - year measure for 2008 California agr icultural consumptive use of Colorado River water under the
first three priorities and the sixth priority of the 1931 California Seven Party Agreement wa s reported as
3.604 MAF. Tracking of use in 2009 is shown in the graph below, and the preliminary year - end estimate
for 2009 is 3.478 MAF. The target under the Interim Surplus Guidelines (ISG) for the end of 2006 was
3.640 MAF, and the target for 2009 is 3.530 MAF, thus California is in compliance with the ISG.

Deadlines for Submissions, which is set forth in its entirety below:

NOTICE OF PARTY STATUS, PREHEA RING CONFERENCE AND DEADLINES FOR
SUBMISSIONS
The Colorado Water Conservation Board (“Board”) has designated Deputy Attorney General Casey
Shpall to act as Hearing Officer for the contested proposed instream flow acquisition in the Stapleton
Brothers Ditc h. The hearing for this matter is set for the Board’s November 2009 meeting.
Pursuant to Rule 6 of the Rules Concerning the Colorado Instream Flow and Natural Lake Level Program
(“Rules”), the Hearing Officer hereby establishes the following deadlines f or party status, written
submissions, designation of witnesses and exhibits, and the prehearing conference.
