Finally, the water court properly applied the RICD statute to determine the amount of <br />water that satisfied RICD criteria. A RICD is a beneficial use and by definition, a use is not <br />beneficial unless it is accomplished without waste. The water court cleazly understood that the <br />prohibition against waste limits the amount of a beneficial use to a minimum amount based on <br />the purpose of the appropriation. The water court gave careful consideration to a11 evidence in <br />its determination of the amount of water that should be decreed, and properly refused to second- <br />guess the applicant's decision regarding the flow rates that will be necessary to support the <br />intended use. If the sta.tutory factors aze satisfied without waste, then the amount of water sought <br />by the applicant must be granted. <br />IV. ARGUMENT <br />A. Recreation Is A Cornerstone of the State's Economy and Recreational In-Channel <br />Diversions Are Necessary to Support this Economic Sector. <br />Recreation has emerged as the fastest growing sector of Colorado's economy, and <br />activities in and on the water are key to its success. The Govemor's office recently appropriated <br />$9 million to spend on marketing Colorado and its tourist and recreational opportunities.l <br />Colorado's Official Tourism website boasts: <br />With dozens of large rivers tumbling steeply down from the mountains, Colorado <br />seemingly was designed with kayaking in mind. Add easy access along major <br />highways to the mix and you have a11 the ingredients for an extended <br />adventure .... Although neazly every sizeable mountain stream has reaches <br />suitable for kayaking, some command international reputa.tions.
