Gunnison"), through its undersigned attorneys, respectfully requests the Court, pLU•suant to <br />C.A.R. 26(b), tc grant a one-day extension of time up to and including September 30, 2004, for <br />Upper Gunnisoii to file its Answer Brie£ As grounds in support of this motion, Upper Gunnison <br />states: <br />7'he Appellants-Opposers, Colorado Water Conservation Board and the State and <br />Division Enginf;ers (herein collectively refened to as "CWCB"), filed a stipulated request for <br />extension of tinie to file their Opening Brief up to and including July 26, 2004, an.d that request <br />was granted by the Court on June 22, 2004. <br />2. 'Che CWCB filed its Opening Brief on July 26, 2004. A Motion for Leave to File <br />Amici Curiae Brief and accompanying Brief of Amici Curiae were also filed on July 26, 2004. <br />The amici cuYicie brief was accepted for filing by the Court on August 12, 2004. :By that <br />schedule, Upper Gunnison's Answer Brief would have been due August 25, 2004. <br />Upper Gunnison and the other active appellees, Colorado River Conservation <br />District and Trout Unlimited, with CWCB's consent, requested and received an initial extension <br />of time to and including September 24, 2004, and a second extension to and inchiding September <br />29, 2004. <br />4. While counsel for Upper Gunnison have been working diligently on their brief, <br />counsel do not believe they can complete it by the close of business today. Uppe,r Gunnison <br />therefore reque;sts a one-day extension, to and including September 30, 2004, within which to file <br />its Answer Bri-,f. <br />-2-
