.? guidance from this boazd, F said that I thought we wauld handle
cross-examination without rt ha.ving it be daect cross-examination
but rather with written questions. And that's all iacluded witbin this
4rder, -as we1L But I want to let you know 13at whatever l do in a
pre-hearing context is simply a recommendation to this boatd. It
dqesu't bind you, so if you would wazLt to change any of those
recommendations, you are very free to do so.
The agencia proposed for the hearing -an,d the order of presentation
was generally - was discussed at the pre-hearing conferenee and was
generally agreed to, atthaugh the actual times given were derived by
me, after consideration of what ha.d been said at the pire-hearing
conference. The times allowed were based generally on the amaunt
of time requested by each parly, each parly understood that it was a
good thing Yo txy ta foreshorten that - the preseaitatians, if possi'ble.
And sa this is rea}ly - this reaU,y amounts to what we hope Would be
a maximum, rather than a minimmm, of'the amounx of time taken by
esch pazty: A,nd the pubuC comments portion was scheduled at a tJme certain
from 4:55 to 5:25, with the hope that that would allow members of
the public to be able #o plan their time arownd their schedutes and
know that that would ha.ppen then; no matter where we aze ui the
heazing, that that public comuent session is -- we more or less
proinised to start it a# that time and hold that tim available for it.
Besides that, T don't think I have any other cbmmerts. The hearriuig
agenda appears onpage three, as I proposed it. And i£the members
•'of the board laave changes they'd Ike to make, I think that woutd be
in order at tbis pomt.
Dan Schwindt: Fqr your information, just - I've had a brief cowmsation dvith the
applicant involved in the main presenter. I don't kaow if t?at's the
aPPropiiate title or not. But betvveen - tbat's scheduled for between
14 and I:30. We'll tty and schedute - make a break $chedule before
- b8iween now and lanch. And we'll try and break for lunch An.d
then the question tha# she had far us is, do we vvaut to leave .
quesanns Ear all af tbeir witnesses to the end or do we want to take
them up as witnesses finish I guess my suggestion, in terms of
keeping us an time, might he to 3eave fhem tii the end, but t?.at's a
-bioard call. .
Feficity Hannay: Nit. Cbairman, I tbink 4 is the board's call. And I Itnow that
sometimes it's usefiil ta ask a question in the finmediacy of the
momenL I noticed, myselt during the previous hearing on the
[tminteIligi'ble] RICD application that firequently a snbsequent
Colorado Water Conservation Board
September 10, 2002:Hearing Transcript
Paqe 2 *
