Cynthia Covel_- Now, the subordination agreement that we're going to be talldng <br />. . about further is an agreementthat allows some of#he in basin users <br />' above the Aspittall rtJnit, which is wha# those stractures together are <br />considersd, to be continued diverting water upstream when thay <br />might atherwise be called aut by the water rights decreed foz that <br />very large Aspinall unit. The amount of depletions contemplated fo'r <br />the users benefited by the subordination agreement is 60,000 aere- <br />feet, total, 20;000 acre-feet of whieh are to occur below the Blue <br />Mesa Reservoa and 40,000 acre-feet of wluch will oceur above the <br />Blue Mesa Reservoic: Some of this has akeady been developed. So <br />you vM hEar tha# the recreationial water right is not going to prevent <br />development of these depletion allowances by the subordinatiQn <br />agreement. Arid it's important to remember, and our witnesses will <br />aZso testify to this, that the 20;000 acre-foot depletion allowance <br />below Blue Mesa Reservoir is certamly not gQing to be irnpactea by <br />this recreational water right because it's a iion-consumptive water <br />right and the water is going to move right on downstream to become <br />avalable to the users who will, benefit be1Qw the Blue Mesa. <br />So of#ha# 44,-000 -acre=foot depletion allowance above B1ue Mesa <br />Reservoir, it's aiso isportaat to remember that appraximately 7,040 <br />acre-feet of tha.t have aheady beefi developed. Thase are senior <br />water rights, they're senior to #he recreativiial water right, And so <br />that piece of developmsnt which has already ocamed won't be <br />affeeted in any fashion. That lea.ves about 33,'000 aer.e-feet <br />remaining. And our witnesses wffi ta}k about what pQtentiai irnpact <br />tbcere may be on tbat 33,000 acre-feet. B4sed on average tis,toric <br />flows at #he Gunnis4n gaiige; after adjustments ftsr diverSions between ttat gauge and-the whitewater course; theFe's approximately <br />150,000 acre-feet between the flows c}aimed iry the Distriet's <br />recreational in-chamel water right aad the average gauge flows. <br />And this is wa.ter that wM be available for substantial developinent <br />upstremn of the wh;tevvater course. And, of course, there will be <br />even mpre water avaiIable in wet year coaditions. <br />So ovr witnesses wffi testify, and I believe the Division Engineer <br />wM confirmy that ia above-average and 'average. .year conditions, this <br />recreational in.-charm,el water rigkt will not caIl out upstream water <br />users who are. diverting under theirjunior. water xights. . <br />Now you'll hear from Cneg Feterson, the President of the Ll?istrict,, <br />tbat the DistriGt is proposing that the recreational in-channel water <br />. riglrt wM not be cailed at times when the Gumtison Tunnel right is <br />calling.
