There really isa't a dzspute and <br />we're not intending to present a lot of evidence or take up your time <br />wrth that. For example, nobody disputes that the Upper Cmmmson <br />R.iver Water Conservancy Bishict is the sort of local government <br />entrty that's authorized to seek a recreation0l in chann.el diversion. <br />It's my undesstauiding, based on the 5taVs proposed <br />recommendation to you; -that there really is no dispute, that the <br />control sfructures that aze proposed for this whitewater course will m <br />hict divert, capture and control and glaci? that water to ben.efieial use <br />wit.hin the reach ofthe recreatianai m channel water right. <br />We_don't.seem to haue a i"eant daspute over whether the reach <br />is an appropriatereach and we don'# seem to have a signfficacit <br />dispute over the question of access.
