Western Colorado Congress, Westem Slope Environmental Resource Council, The <br />Wilderness Society, and Trout Unlimited ("Environmental Parties"). Counsel for Interior <br />and for the Environmental Parties agreed to confer before the hearing to try to resolve <br />Interior's potential objection. If the objection has not been resolved, the Board will be <br />asked to make a determination as to the admission of this exhibit at the time of the <br />hearing. <br />5. Acceptance of Exhibits. With the exception of the document referred to in <br />subparagraph B.4., above, the Hearing Officer recommends that the Board accept into the <br />hearing record all of the exhibits identified in the CWCB Staff's and Parties' prehearing <br />statements. If further exhibits are identified in the Parties' and Staff's rebuttal <br />statements, the Hearing Officer will make a recommendation regarding their acceptance <br />into the record at the time of the hearing. <br />6. Rebuttal Statements. The Parties may submit rebuttal statements by close of <br />business on Friday, October 17. <br />7. Potential Stipulations. The Parties and CWCB Staff will continue to confer <br />with one another in an attempt to narrow and perhaps even eliminate the contested issues <br />prior to the hearing. The Hearing Officer set a deadline of Friday, November 7, for the <br />submission to the Board's office and the Hearing Officer of written stipulations proposed <br />to resolve the contested issues between the CWCB Staff and one or mare of the Parties. <br />If appropriate, the Hearing Officer may issue an amended prehearing order based on any <br />such stipulations received by close of business on November 7. This deadline is only for <br />the submission of written stipulations to the Hearing Officer prior to the hearing, and is <br />not intended to stop the Parties and Staff from continuing their efforts to reach agreement <br />up to the date of the hearing, if necessary. <br />C. Hearing Agenda <br />The Hearing Officer recommends the following hearing agenda to the Board. It is <br />expected that throughout the hearing, the Chairman will call breaks as appropriate. It is <br />possible that the hearing may continue while the Board members eat their lunch and/or <br />dinner; if this happens, arrangements will be made far the other hearing participants to <br />obtain and eat their meals as well. With the exception of the "Public comments" session, <br />which will occur as close as possible to the scheduled time, this proposed schedule may <br />vary slightly at the Board's discretion to provide for breaks and to accommodate <br />reasonable changes in circumstances. <br />10:00 - 10:15 a.m. Introductory matters, procedural questions, Board <br />approval of hearing agenda and determination of any <br />outstanding procedural matters <br />10:15 - 11:15 a.m. Presentation of ISF recommendation by CWCB Staff <br />(1 hour). <br />11:15 a.m. - 12:15 p.m. Presentation by U.S. Department of the Interior (1 hour). <br />3
