Box 1120 <br />Glenwood Springs, Colorado 81602 <br />Phone: (970) 945-8522 <br />Fax: (970) 945-8799 <br />E-mail: rtenney@crwcd.org <br />as its representative to act for the River District in connection with this <br />Agreement. <br />B. Summit County designates Sue Boyd, whose address, telephone number, fax <br />number, and e-mail address for notices and communications are: <br />Summit County Government <br />P.O. Box 68 <br />Breckenridge, CO 80424 <br />Phone: (970) 453-3401 <br />Fax: (970) 453-3535 <br />E-mail: sboyd@co.summit.co.us <br />as its representative to act for Summit County in connection with this Agreement. <br />The designation of contract officers may be changed by notice given in the <br />manner provided in paragraph 11. <br />12. Breach, Notice of Breach, Right to Cure, and Remedies. The parties have the right to <br />seek specific performance of the terms of this Agreement. In the event of a dispute under <br />this Agreement, the parties agree to address the dispute through non-binding alternative <br />dispute resolution prior to initiating litigation. No suit concerning a breach or for <br />enforcement of this Agreement shall be filed unless the nondefaulting party has first <br />given the other party written notice of the alleged breach and a period of thirty (30) days <br />to cure that breach. In the event of litigation between the parties concerning this <br />Agreement, the prevailing party shall be awarded attorney's fees to the extent permitted <br />by law. Neither party hereby waives nor relinquishes any defenses or immunities from <br />liability which they may have under law.
