Material injury to the ISF or Natural Environment during <br />Construction <br />Construction of the RICD structures in the Course will not cause material <br />injury to existing ISF water rights and will not negatively impact the natural <br />environment for which the ISF was created. <br />The Colorado Division of Wildlife (CDOW) is concerned with <br />the timing of construction in order to minimize impact to <br />fisheries and the aquatic environment of the River. Based on the <br />concern of the DOW and any future comments, Silverthorne will <br />construct the rock control structures in the Course during a <br />period of the year when it will minimize impacts on the Blue <br />River fishery. Silverthorne will consult with CDOW to work out <br />a mutually agreeable time in which to construct the control <br />structures. <br />• Silverthorne has worked closely with CDOW in the past in the <br />construction of fish habitat improvements on the Blue River and <br />will work closely with CDOW in the construction of the Course. <br />. Construction and installation of the controls structures will occur in <br />coordination with all local, state, country and federal permits requirements. <br />In particular, strict coordination with the Colorado Division of Wildlife will <br />occur to ensure that the impact to fishing habitat is minimized. For the <br />construction effort, guidance regarding time of the year and construction <br />measures will be sought and incorporated. Construction practices will <br />minimize disturbance to the River and minimize sediment movement. <br />5. The Silverthorne RICD will promote maximum utilization of the waters of the <br />State: <br />a. Future Upstream Junior Appropriations for Direct Diversion or <br />Storage <br />The Course will produce an additional use of the Blue River with associated <br />economic benefits without diminishing either water quality or quantity. <br />b. Probable Future Changes Transfers, or Exchanges of water rights <br />from Points of Diversion Downstream <br />There is very limited potential for future upstream junior appropriations for <br />direct diversion or storage because the Blue River is over appropriated and the <br />existing decreed exchanges through the Course together with the decreed ISF <br />• rights make future upstream exchanges very difficult to obtain.
