Loan Contract No. C-15O~)30 ("Loan Contract") between the CWCB, District and the Enterprise, a copy or which is attached and incorporated herein as Exhibit A, and ~vhic}~ provides for a loan by the CWCB to the Enterprise in an amount of $100,000.00 for the rehabilitation of a water diversion and delivery system, is hereby endorsed, authorized and approved. 2. Consistent with the terms of the Loan Contract, the Enterprise shall set, maintain and collect water user rates, fees and charges in amounts sufficient to allow the Enterprise to repay the loan in a full and timely fashion. 3. Consistent with t11e Loan Conh~act, the Enterpriseshall establish and maintain a separate and distinct account into which revenues from water user rates, fees and eharges shall be deposited in sufficient amounts to pay the annual loan installments as called for ur~der the loan; and shall, additionally establish and maintain a separate and distinct reserve debt service fund. ~ 4. The Districtendorses the pl evenues bythe Enterprise derived from water user cates, fees and charges to repay th n, n to pledge certain property as collateral for the loan and to execu m t o convey a security interest in said property to the CWCB, and/or t n a ertificate of Deposit in the amount of one annual loan payment to serve as collateral and to execute an Assignment of Certificate of Deposit. 5. Consistent with the terms of the Loan Contract, the District shall not endeavor to terminate or dissolve the Enterprise, nor adversely withdraw or deplete its assets, nor otherwise advei~sely affect the ability ot the Enterprise to perform the terms of the Loan Contract during the term of the Conh~act. f~. The District shall take such other actions a nd execute such other documents as may be necessary to consummate and implement the loan between the CWCB and the Enterprise.
