<br />RESOLUTION <br />Resolution No. 2000- <br />A RESOLUTION OF THE SILT WATER CONSERVANCY DISTRICT <br />AUTHORIZING AND ENDORSING A LOAN BETWEEN THE SILT WATER <br />CONSERVANCY DISTRICT WATER ACTIVITY ENTERPRISE AND THE COLORADO <br />WATER CONSERVATION BOARD. <br />WHEREAS, the Silt Water Conservancy District ("District") has established the Silt <br />Watei• Conse~vancy Disti•ict Water Activity Enterprise ("Enterprise") as authorized and <br />referenced in Section 37-45.1-101, et seq., ~f the Colorado Revised Statutes (1999), and <br />Article X, Section 20 oF the Colorado Constitution; and <br />WHEREAS, the Colorado Water Conservation Board ("CWCB") has agreed to <br />extend a loan oF$"lOU,UOU.OO to the Enter • help finance the rehabilitation otia water <br />diversion and delivery system; a~ <br />WHEREAS, the Enterprise is a ai powered by Section 37-45.1-104, <br />C.R.S. (1999) to incur indebte t ce oE its operation; and <br />WHEREAS, the loan as extended to the Enterprise will not constitute a debt of the <br />District within the meaning of any constitutional or statutory provision or limitation; and <br />WHEREAS, the loan is to be repaid exclusively from revenues generated and <br />collected trom water syste-1~ service fees, rates and charges; and <br />WHEREAS, the watersystem service fees, rates and charges shall be established by <br />the Enterprise; and <br />WHEREAS, the District, through the operation of the Enterprise, is to maintain <br />separate and distinct records and funds respective to Enterprise expenditures and revenues; <br />a n ~i <br />WHEREAS, the District desires tc~ endorse the CWCB loan and undertake those <br />commitments and actions necessary to effectuate and implement said loan. <br />1VOW, THEREFORE, BE IT RESOLVED BY THE DISTRICT, AS FOLLOWS: <br />Res~~lutinrt <br />5ilt lV~~l~~rCniir;rr~~~nrr-y [~i.tifri~~f <br />Pn,~~r 7 <br />Appendix A to Loan Contract C150030 <br />
