<br />2. Financial obtigations of the State of Colorado payable after thc current fiscai year are contingent upon funds for that
<br />purpasc being approptiated, budgeted, and otherwise rnade available.

<br />3,1: this contract involves the payment of more ihan fifty thousand dollars for the coastsuction, erection, repair, raaintenance,
<br />or irnprovemcnt of any building, Toad, bridge, viaduct, tunnel, Gxeavatioa or othar public wark for this State, the cantractor
<br />shaIl, befare entering nFon the perfomance of any such work included in this conuact, duly cxecute and doliver to the Stace
<br />afficial who witI sign the contract, a good and sufficient bond ar other acceptable sartry to be approved by said official in a
<br />penal sum not less ihan ona-hatf of the total amount payable by the terms of this contract. Such band shail be duiy executed
<br />by a qualified corporate surery eonditioned upon the faithfui performance of the contract and in additior., shall provide that if
<br />the c4ntractor or his subcontractors fail to duly pay for any labor, materials, team hire, sustenance, provisions, provcndor or
<br />other suppties used or consumed by such canttactor or his subcontractor in performance of the work contracted to be done or
<br />fails to pay any person who suppiies rentaJ rnachinery, taats, or equipment in the prasecution of the work the surery wi!! pay
<br />the same in an amount not exceeding the sum specificd in the bend, together with interesr at the rale of eight per cent per
<br />annum. Unless such bond is executed, delivered and f?led, no ctaim in favor af the eontractor arising under such cont; azzt
<br />shaU be audited, allowed or paid. A certificd or cashicr's check or a bank-money order payable to the Treasurer of the State

<br />agencs, against any and all claims, darrsages, liabiliry and couri awards inclvding costs, txpcnses, and attorney fees incurred
<br />as a resuit of any act or omission by the contractar, or its employees, a;ents, subcontractors, or assignees pursuant to the
<br />tertns of this contract.
