D 10 NOTICE REGARDING BUY AtvIEWCAN ACT , <br />Ia accordance with Sectian 505 of Pub, L. I04-46 (109 Stat. 429), as implemented by 43 CFR 12.710, please <br />be advised of the following: <br />It is the sense of the Congress that, to the greatest extent practicable, all equipmcnt and produc#s <br />purchased with funds made available in ihis Act should be Amencan-made. . <br />D.11 RESOLVING DISAGRE£MENTS • <br />In entering into a cooperative agreement with the Nebraska Community Foundation, the other parties to the <br />Agreement are committed to working with the Foundation and oach othar in a harmonions manner to achieve <br />the objectives of the project successfulty. When disagreements arise among the parties, they must be resolved <br />according ta the grocedures discussed below; <br />' a. Raciamation and the States shall attempt fcrst to resolve disagreements with the Foundation through <br />informal discussion with the foundation's Project Direetor. ' <br />b. If the disagreement cannot be resolved through informal discussion among these parties, fae <br />Executive Dirsctor wili arrange a formal meating between the Foundation's Project Director and the <br />Governance Committee. If agreement still cannot be reached, t'ae parties witl colfeetively decide on any <br />varied appraaches which might be used to resolve the disagreement. The parties shall be responsibie for their <br />individual expenses related to any appraach utilized to resolve the disagreemeni. If attempts at r-esolving the <br />disagreement fail, Reclamatian and the States shall meet and malce a decision with approval of the Governance <br />v • <br />• Committee. The Foundation may pucsue the appropriate appoais procoss if there is a disagreement with the <br />decisian. <br />c. Nothing herein shall be eonstrued to delay vr limit Reciamation's right to take immediate and <br />apprapriate action, as set forth at 43 CFR, Subpact 12.83, in the event of rnaieria) noacompliance by the <br />•• fflundation, and no attempts at informal resolution shall be neoessary. <br />Any gost•award issue wi11 be open for resolution in accordance wiih the abave procedures, with the cxception <br />of disagreements regardir.g continuation af the agreement (since either party may terminate the agreement <br />' with the specified notice), or other matters specifically addressed by the agreement itself. <br />D.12 CERTIFICATES <br />The fo(lowing certifcacions are incorporated by reference and made a part of this agreement: <br />CertificatioRS Regarding Debarment, Suspension, and Other <br />Respo:?sibiliry Matters, Drvg-free Workplace Requirements and Lobbying (DI-201 0)
