REIMBURSABLE AGREEMENT <br />BETWEEN <br />Nebraska Community Foundation, <br />Platte River Recovery Implementation Program <br />AND <br />UNITED STATES FISH AND WILDLIFE SERVICE <br />1. Parties. <br />Agreement <br />Page 1 of 9 <br />This Agreement is made and entered into by and between the Nebraska Community Foundation, <br />Inc. (Foundation) of Lincoln, Nebraska representing all signatories to the Platte River Recovery <br />Implementation Program, hereinafter referred to as "PRRIP" and the U.S. Fish and Wildlife <br />Service (FWS), Technology Applications Team hereinafter referred to as "TAT." The following <br />persons are authorized to represent the parties through this agreement: Jeff Yost of the <br />Foundation and Elliot Sutta of the FWS. <br />2. Purpose. <br />The purpose of this agreement is to allow the Foundation, acting as the fiscal agent for ihe <br />? Governance Committee of the PRRIP, and TAT to enter into a cost not to exceed reimbursable <br />agreement contract for the project "Database Management System Development and <br />Implementation." <br />3. Legal Authorities. <br />This agreement is authorized by the following laws, regulations, ordinances, bylaws, or other <br />documents: <br />FY 2000 Interior and Related Agencies Appropriations Act (PL 106-113) <br />The Fish and Wildlife Coordination Act (16 U.S.C. 661 et seq.) <br />The National Wildlife Refuge System Administration Act of 1966, as amended (16 U.S.C. 668dd <br />et seq.) <br />National Defense Authorization Act, Fiscal Year 2002 (Public Law 107-107) <br />4. Background. <br />A basin-wide cooperative program relating to four target species (interior least tern, piping <br />plover, whooping crane and pallid sturgeon) and their associated habitats, as defined in the Platte <br />River Recovery Implementation Program (PRRIP), began January 1, 2007. As signatories the <br />States of Colorado, Nebraska and Wyoming and the Department of the Interior (DOI) agreed to <br />"...participate in the Governance Committee which is hereby established pursuanf fo Section 4 of fhe <br />Endangered Species Act (`ESA') (16 U.S.C. 1531 et seq.) to oversee implementation of the PRRIP. <br />The PRRIP implements certain aspects of the U. S. Fish and Wildlife Service's recovery plans for four <br />? target species (interior least tern, whooping crane, piping plover and pallid sturgeon) listed as <br />threatened or endangered pursuant to the ESA. The PRRIP provides for a range of ineasures relating <br />to the four target specie in their associated habitats as defined in the PRRIP."
