<br />6. If, as of the hearing date, a valid protest has been filed (25% of the owners of <br />land), then Court will order an election. If no valid protest has been filed, the <br />Court will order formation of the subdistrict. <br />7. In order to achieve maximum mill levy potential, the total assessed valuation <br />of the subdistrict should remain below twenty (20) million. If the total value <br />exceeds this amount, the District could consider forming several subdistricts. <br />A. If the subdistrict initially starts out with a total assessed valuation of <br />under 20 million, the mill levy would be 1 1/2 mills and go up to 3 <br />mills upon delivery of water, and by election of inembers go up to 9 <br />mills. <br />B. If the subdistrict initially starts with a total assessed valuation of <br />20 - 50 million, the mill levy would start at 1 mill, go up to 2 mills <br />upon delivery of water and by election go up to 6 mills. <br />C. If the subdistrict starts with a total assessed valuation of over <br />50 nnffion, the mill levy starts at '/2 mill going tc 1 mill upon <br />delivery of water and by election go to a maximum of 3 mills. <br />(Counsel Lawrence noted that it was his opinion the District <br />could consider the delivery of water it has made in Sedgwick <br />County when determining when or if to raise the mill levy within <br />the District from %2 to 1 mill). <br />Counsel Lawrence will report back to the Board on whether the <br />law requires a vote of constituents when considering raising the mill <br />levy upon delivery of water or whether the Board can raise the mill <br />IeL'y by ReSOiUtiOri. <br />No tax revenues will be received in 2003 or 2004. It is too late to benefit from <br />2003 taxes (co?ected ir. 20?4), ar.d 2004 taxes, ?? u?h t?? new subdistrict will be <br />eligible to receive, will not be paid until 2005. The subdistrict may impose fees <br />prior to that date, but should not expect tax revenues prior to mid 2005. <br />9. It is too late to schedule an election to increase the mill levy in 2003. The election <br />can occur in 2004, the new mill levy will be imposed in 2005, and the first <br />collections at a higher mill up to the 9 mill rate will be received in 2006. <br />General Manager, John Eckhardt discussed services the District could offer. 1) Legal and <br />engineering services to get augmentation plans decreed.
