Notes from March 21, 2007 Platte River Recovery Implementation Program meeting <br />PBO = non jeopardy for target species, wpf orchid, bald eagle in centraUlower Platte. <br />American burying beetle = NLAA & Eskimo curlew = No Effect. <br />Other species & critical habitat not addressed by PBO. <br />Template bioloizical assessment (BA) <br />Template (BA) addresses above species, supplement as needed for other listed species <br />Different Depletion Plan for each state, therefore different template BA for each state <br />CO & W1' template BA developed, need to develop one for NE and Feds <br />Template biolo ical opinion (BO) <br />Template BO addresses above species only. <br />FWS will either blend or partition other species as needed into one biological opinion <br />Recovery Agreements (RA) <br />Generally required in Colorado for both existing and new uses <br />Agreement between Water User and USFWS (join SPWRAP) <br />(North Platte vs South Platte & existing Fed depletions still under discussion) <br />In Wyoming, RA only used if User needs to qualify as an existing use or offset a new use <br />Agreement between Water User and Wyoming <br />Agreement between Water User and USFWS <br />Recovery Agreement to be developed in NE? <br />Addressing Past ConsultatiOns (those that anticipated relying on Program) <br />Prior to Program, a"Minor Depletions BO" was available to cover depletions < 25 ac-ft. <br />With Program, this BO only available for projects located below Loup River confluence. <br />In general, no .longer any procedural distinction between "major" and "minor" depletions. <br />Any "Minor Depletions BOs" initiated prior to Program are done, no further action. <br />BOs with "Major" existing depletions cease interim annual payments to NFWF. <br />Recovery Agreement & SPWRAP membership required in Colorado to rely on Program. <br />Addressing Future Consultations (Colorado) <br />Generally requires a template BA and a Recovery Agreement if applicable <br />SPWRAP membership required in Colorado <br />SPWRAP contact is Kevin Urie, kevin.urie@denverwater.org, 303 628-5987 <br />Lead Federal agency provides BA, signed Recovery Agreement; FWS signs Recovery <br />Agreement and returris a copy with the BO. <br />South Platte Water Related Activities Program, Inc. (SPWRAP) <br />SPWRAP is a Colorado nonprofit corporation established by Colorado water users for the <br />purpose of representing water users' interests and partnering with the State of Colorado <br />to implement the Program.
