SECTION A. PURPOSE AND BACKGROUND A.1. PROJECT TTTLE: Administrative Support to the Governance Committee and Executive Director Established Pursuant to the July 1997 Cooperative Agreement for Platte River Reseazch and Other Efforts (Including the 2006 Program Agreement) Relating to Endangered Species Habitats Along the Central Platte River, Nebraska (references to this effort shall be described as the `July 1997 Agreement')." A.2. BACKGROUND a. A purpose of the July 1997 Agreement is to implement certain activities related to four target species listed as threatened or endangered pursuant to the Endangered Species Act (ESA). The July 1997 Agreement requires that a Governance Committee be esta.blished to review, direct and provide oversight for all those activities except National Environmental Policy Act (NEPA) and ESA compliance. The Governance Committee's general purpose is to establish Land and Water Management Committees and additional committees; serve as arbiter of disputed external peer reviews, allocate funds and other available resources to any of its committees; enter into an agreement for the administration of certain funds; assess accomplishments, implement corrective measures and revise milestones; and develop specific milestones for implementing a program. b. The Executive Director is required under existing agreements with each state to report to and carry out the direction of the Governance Committee and to assist other committees. c. The Governance Committee, Executive Director, and other committees require administrative support in order to accomplish the purpose of the July 1997 Agreement. d. The Platte River Implementation Governance Committee, Interim Executive Director, Executive Director and other committees require administrative support in order to accomplish the purpose of the December 2006 Program Agreement, scheduled to begin January 1, 2007 A.3. PURPOSE AND OBJECTNE The purpose of the agreement is to establish a finance management process and provide administrative support to aid the Governance Committee, Executive Director and other committees established in accordance with the July 1997 Agreement in executing their responsibilities. All activities of the Foundation under this agreement will be governed by the provisions of OMB Circular A-110 and applicable laws of the 5tates of Colorado, Nebraska, and Wyoming, including the requirements found in Attachments C, N, and W. The puipose is also to provide services to the Platte River Implementation Program Governance Committee, Interim Executive Director, and Executive Director. A.4. AUTHORITY This agreement is entered into pursuant to the Endangered Species Act, Public Law 93-205, and the Fish and Wildlife Coordination Act of 1934 as amended, including Public Law 85-624, and applicable laws of the States of Colorado, Nebraska, and Wyoming.
