ATTACHMENT K <br />Cooperative Agreement <br />No. 99-FC-60-11870 <br />AGREEMENT BETWEEN: <br />DEPARTMENT OF THE INTERIOR, BUREAU OF RECLAMATION (Reclamation); <br />STATES OF COLORADO, NEBRASKA, AND WYOMING (States); <br />AND THE NEBRASKA CON7MUNITY FOLTNDATION, A NONPROFIT FOiJNDATION (Foundation) <br />FOR ADMINISTRATNE SUPPORT TO THE GOVERNANCE <br />COMMITTEE AND EXECUTNE DIltECTOR FOR THE PLATTE RNER <br />ENDANGERED SPECIES PARTNERSHIP <br />RECITALS <br />1. Reclamation, the States and Nebraska Community Foundation entered into that certain <br />Cooperative Agreement, dated July 1, 1997, which was effectuated, in part, in 1999 through <br />Contract No. 99-FC-60-11870 (the "Original Agreement"), as amended by the State of Colorado <br />and the Nebraska Community Foundation with the following: Amendment #l, dated October 27, <br />1999, Contract No._O1 PDA 00024 (the "First Amendment"); Amendment #2, dated December 4, <br />2003, Contract No. 04 PDA 00035 (the Second AmendmenY'); Amendment #3, dated May 12, <br />2004, Contract No. 04 PDA 00075_(the "Third Amendment"); Amendment #4, dated March 31, <br />2006, Contract No. 06 PDA 00073 (the "Fourth Amendment"); and, Amendment #5, dated April <br />10, 2007, Contract No. 07 PDA 00083. <br />2. In addition, Reclamation, the States and the Nebraska Community Foundation, agreed to fifteen <br />modifications that can be described as follows: <br />Modification No. 1(9/2/99): U.S. authorized the expenditure of an additianal $650,000. <br />Modification No. 2(11/05/99) changed the fee structure/disbursement <br />Modification No. 3(8/7/00?: Extended the agreement until March 31, 2001. <br />Modification No. 4(3/21/01): Extended the agreement until September 30, 2003; revised fee <br />structure; Revised Colorado's and Wyoming's special provisions. (Amendment 1) Colorado <br />authorized the expenditure of an additional $50,362.72. <br />Modification No. 5(5/11/0 1): U.S. authorized the expenditure of an additianal $160,000. <br />Modification No. 6(12/8/01): U.S. authorized the expenditure of an additional $300,000 <br />Modification No. 7(6/5/02): U.S. authorized the expenditure of an additional $400,000 <br />Modification No. 8(8/29/03) (Amendment 2): Agreement extended until March 31, 2004. <br />Modification No. 9(12/23/03):U.S. authorized the expenditure of an additianal $400,000 <br />Modification No. 10 (5/13/04) (Amendment 3): Agreement extended until March 31, 2006. <br />(Amendment 3) Colorado authorized expenditure of an additional $37,490. <br />Modification No. 11 (9/19/05): U.S. authorized expenditure of an additianal $411,428. <br />Modification No. 12 (9/23/05): U.S. reduced their expenditure by $288,739. <br />Modification No. 13 (4/7/06,) (Amendment 4): Agreement extended until June 30, 2007. <br />(Amendment 4) Colorado authorized the expenditure of an additional $37,489. <br />Modification No. 14 (7/24/06): U.S. autharized expenditure of an additional $159,765. <br />Modification No. 15 (5/1/07) (Amendment 5„Z U.S. authorized expenditure of an additional $1 <br />million. (Amendment 5) Agreement extended until September 30, 2007. <br />States percentages changed and other language added to reflect the Program start. <br />Colorado replaced its special provisions and authorized expenditure of an additional <br />$394,791.90. <br />Modification No. 16 (8/22/07): U.S. authorized expenditure of an additional $1 millian <br />The Parties desire to restate the terms and conditions of the Original Agreement, as amended by <br />the five amendments and the sixteen modifications into a single restated agreement (collectively <br />herein referred to as the "AgreemenY').
