3.0 INSTITUTIONAL ARRANGEMENTS <br />3.1 INTRODUCTION <br />The Program described in this document provides a frarnework for implementing measures to <br />restore and conserve threatened and endangereri species habitat on the Platte River in Central <br />Nebraska. The Program will be carried out by a Conservation Committee made up of <br />representatives of the Department of the Interior, three States, water development interests, <br />conservation organizations, and Kingsley interests. (Combination of Central Nebraska Public <br />Power and Irrigation District and Nebraska Public Power District). <br />3.2 COOPERATIVE ?;GREEMENT <br />The Secretary of the Interior and the Governors of the three States will execute a Cooperative <br />Agreement endorsing and adopting this Program and establishing a high-level Conservation <br />Committee charged with overseeing implementation of the Program. The Cooperative <br />Agreement will incorporate the terms, objectives, and undertakings of this Program and will <br />commit each party to its timely implementation. The Cooperative Agreement will be executed <br />under the statutory authority of the Endangered Species Act and other appropriate Federal and <br />State laws. Participation in the Program does not in any way diminish, detract from, or add to <br />the authority and responsibilities of the States or Federal government. Beyond the role of the Secretary and the Governors, it is apparent that a commitment on the part <br />of conservation organizations, water development associations, and Kingsley interests will be <br />required. For that reason, interested parties wishing to participate in the Program, including <br />water development associations, conservation organizations, and Kingsley interests, will enter <br />into supporting resolutions that set out the respective parties' expectations and responsibilities <br />for the Program's provisions. <br /> <br />32
