~5 <br />The Service does not anticipate that the proposed action will result in any <br />incidental take of tike endangered fishes; and therefore no take is authorized. <br />~ummarv <br />This concludes the Service's biological opinion on the impacts of several <br />historic and new projects. If new information becomes available, if new <br />species are listed, or if there should be any changes in total annual amount <br />of water depleted or any change which alters the operation or timing of the <br />projects from that described herein and which may affect any endangered or <br />threatened species in a manner or to an extent not considered in this <br />biological opinion (see 50 CFR 402.16), formal section 7 consultation should <br />be reinitiated. If during the process of fulfilling the reasonable and <br />prudent alternative, RIP participants are unable to comply with those measures <br />identified in this opinion, this determination would constitute new <br />information requiring the action agencies to reinitiate consultation. <br />Certain elements of the reasonable and prudent alternative require a 3-5 year <br />study of Colorado squawfish, razorback suckers and their habitat needs in the <br />Duchesne River. At the end of the study effort, data should be available to <br />determine specific flow requirements and the extent of accomplishments in <br />obtaining water or operational flexibility to meet those needs. Consultation <br />will then be reinitiated or this final biological opinion will be amended to <br />include final flow recommendations. <br />In keeping with the RIP's section 7 agreement, existing diversions wil l <br />continue and projects under construction will continue provided the reasonable <br />and prudent alternative identified in the opinion is being completed as <br />scheduled. Projects being planned will be able to proceed through <br />construction, however, the actual diversion of those new depletions will be <br />contingent upon completion of specifically identified RIP RAP items prior to <br />such depletions. <br />Because the Service has identified on-going Federal actions in this opinion as <br />likely to jeopardize the continued existence of the listed Colorado River <br />fishes and is likely to destroy or adversely modify their critical habitats, <br />responsible federal action agencies need to formally notify the Service of <br />their final decision on the implementation of the reasonable and prudent <br />alternative. In order to keep State agencies, the Northern Ute Tribe, water <br />user groups, and other interested parties apprised of the Service's concerns. <br />copies of this opinion will be distributed to those entities. <br />
