44 <br />seed sources that contribute nonnative fishes to high priority reached. <br />Nonnative control efforts should be expanded to include problem species in <br />the Duchesne River. <br />General Recovery Support Action Plan: <br />IV.E.2.a Ouray Expansion <br />The construction of Ouray National Fish Hatchery and ancillary facilities <br />must be completed in accordance with the RIP RAP schedule. This hatchery, <br />a key reproduction facility, is designed to assist in the recovery of all <br />four listed Colorado endangered fishes. <br />Species experts agree that the Green River and its tributaries represent <br />perhaps the most important riverine habitats left for rare and endangered <br />fishes in the upper Colorado River Basin. As such, protection of these areas <br />are imperative to the continued existence and eventual recovery of these <br />species. All elements of this reasonable and prudent alternative are integr~~l <br />to improved understanding of both the biological and physical needs of <br />endangered fish in the Duchesne River Basin, and how those needs can best ~c~ <br />accomplished. <br />Future decisions about endangered fish needs on the Duchesne River must be <br />based on the best scientific and commercial data available, and will be <br />largely dependent upon the outcome of investigations associated with this <br />reasonable and prudent alternative. The ultimate goal of the research effort <br />is to determine the role of the Duchesne River in recovery of the endangered <br />fishes in the Green River sub-basin and to characterize those biological aril <br />physical factors which may limit the Duchesne River's ability to contribute to <br />recovery in the Upper Basin. Successful implementation of all elements of <br />this reasonable and prudent alternative will allow the RIP to serve as the <br />reasonable and prudent alternative for Federal actions which result=in <br />depletion impacts to the Duchesne River. <br />Section 9 of the Endangered Species Act, as amended, prohibits any taking <br />(harass, harm, pursue, hunt, shoot, wound, kill, trap, capture or collect, or <br />attempt to engage in any such conduct) of listed species without a special <br />exemption. Under the terms of section 7(b) (4) and section 7(0) (2), taking <br />that is incidental to and not intended as part of the agency action is not <br />considered taking within the bounds of the Act, provided that such taking is <br />in compliance with the incidental take statement. <br />
