Ensure that land and waters for fish and wildlife are acquired in <br />phase with other project features <br />7. Require that the public be given every appropriate opportunity for <br />participation in planning <br />8. Authorize the institution of citizen suits alleging violation of <br />the Act or regulations orders, or permits issued pursuant tq the Act. <br />Points 1 and 2 involve strengthening of the formulation process; the bargain- <br />ing process would be improved through points 3 and 4; the implementation of <br />measures is enhanced by points Sand 6; and points 7 and 8 involve the total <br />process. <br />The formulation process needs to be strengthened by requiring that <br />written reports of fish and wildlife agencies clearly specify the measures <br />and features recommended for fish and wildlife agencies conservation and <br />development, the lands to be utilized or acquired for such purposes, the <br />results expected, the damage to fish and wildlife attributable to the pro- <br />ject, and the measures proposed for preventing, mitigating, and compensating <br />for such damages.. The findings have shown that measures were sometimes re- <br />quested in qual itative terms. For example. requests for flow f1 uctuation <br />control for many projects left quantities of fluctuation open-ended by ex- <br />pressions such as "gradual changes.1I IIfluctuations be kept to a minimum," or <br />IIregulated evacuation." Requests of this nature were usually accepted and <br />implemented because no specific action is required. At Palisades Dam, Idaho. <br />the Fish and Wildlife Service originally requested that large changes in the <br />volume of release be made gradually. This vague recommendation has been re- <br />fined over the years to an annual negotiated release schedule to protect water- <br />fowl production on the basis of post-construction waterfowl studies by Idaho <br />.Department of Fish and Game. <br />Also. the effect on the biota with and without the measure and/or project <br />are fOr the most part expressed in general terms.
