<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />uses within western Colorado (which were perfected by use on or before <br />October 15, 1977), and the water need is not met by rel ease from the <br />replacement pool, water will be released without charge from Green <br />Mountain Reservoir from the 100,000 acre-foot power pool to the extent <br />necessary to permit diversions to the full amount of these decrees. <br />However, releases from the power pool for these purposes shall not <br />exceed 66,000 acre-feet of water annually (measured at Green Mounta in <br />Dam). This quantity is deemed adequate to satisfy all perfected uses <br />with a priority date senior to October 16, 1977. <br /> <br />Policy Statement 5. Differential water service charges will be <br />assessed for water released for domestic, irrigation, and industrial <br />purposes. For the purposes of the operating policy, the following defi- <br />nitions of water use apply: <br /> <br />a. Domestic Use--The use of water by individuals, cities, <br />towns, public or quasi-public districts, private corporations, <br />home-owners' associations, or other entities for domestic, munici- <br />pal, and miscell aneous rel ated purposes as those terms are trad i- <br />tionally and corrmonly construed, excepting only the irrigation and <br />industrial uses of water as defined below. <br /> <br />b. Irrigation Use--The use of water for the cOl11llercial pro- <br />duction of agricultural crops and 1 ivestock and other uses con- <br />sistent with any water right decreed for irrigation purposes. <br /> <br />c. Industrial Use--The use of water for purposes of producing <br />or processing a nonagricultural product or service for sale, <br />including without limitation such uses as manufacturing, mining, <br />milling, land reclamation, snownaking, and nonhydroelectric power <br />generation. <br /> <br />Policy Statement 6. Agreements may be consummated with water users <br />in the geographic area of the Colorado River Basin. The water may be <br />used in accordance with Colorado State law directly, by exchange, or by <br />augmentation of water development to enable water to be beneficially <br />used in western Colorado. Any agreements for such use shall be referred <br />to the State Engineer for review as to administration feasibil ity prior <br />to execution. Such water service agreements shall be provided to the <br />Division Engineer of the State of Colorado for administration of <br />releases and deliveries. <br /> <br />Pol icy Statement 8. In order that no waste of water resul ts from <br />unnecessary storage, and in order to maximize the beneficial use of <br />water stored in Green Mountain Reservoir, the Regional Director, Lower <br />Missouri Region will determine on a yearly basis the anticipated amount <br />and uses of stored water reasonably necessary to meet the stated objec- <br />tives of the operating pol icy. Any stored water in excess of this may <br />be disposed of on an interim basis by contractual agreement. <br /> <br />Policy Statement 9. Revenues resulting from any agreements pro- <br />vided for in the operating pol icy will be credited to the operation and <br />maintenance costs of Green Mountain Dam and Reservoir, to power replace- <br />ment, and to appropriate project costs. <br /> <br />- 5 - <br />
