S.10 RELATED AND ONGOING ACTIONS <br />This section describes laws and projects that affect the operation of Flaming Gorge Dam <br />and may affect the potential impacts of the Proposed Action. Where applicable, these <br />laws and projects are factored into the analysis of potential impacts under both <br />alternatives, particularly in the Cumulative Impacts analysis of the DEIS. <br />S.10.1 Regulatory Requirements <br />Federal statutes establish a number of responsibilities for the Secretary of the Interior. <br />These legislated responsibilities relate to the management of numerous agencies, projects, <br />and lands, all or some relating to the operation of Flaming Gorge Dam. In some cases, <br />the statutes specifically require the Secretary of the Interior to mandate responsibility for <br />management of reservoirs; while in others, the statutes allow the Secretary of the Interior <br />to grant discretionary authority. <br />5.10.1.1 The Law of the River <br />As a tributary of the Colorado River, the Green River is managed and operated according <br />to a collection of over 50 compacts, Federal and State laws, court decisions and decrees, <br />contracts, treaties, and regulatory guidelines collectively known as the Law of the River. <br />This collection of documents apportions the water among the seven Basin States and <br />Mexico, and regulates and manages riverflows. Some of the statutes included within the <br />Law of the River having a major impact on dam operations include the Colorado River <br />Compact of 1922, the Upper Colorado River Basin Compact of 1948, the Colorado River <br />Storage Project Act of 1956, which authorized a comprehensive water development plan <br />for the Upper Basin that included the construction of Flaming Gorge Dam, and the <br />Colorado River Basin Project Act of 1968. <br />5.10.1.2 National Parks and Recreation Areas <br />The affected environment for the DEIS includes portions of Flaming Gorge National <br />Recreation Area, Dinosaur National Monument, and Canyonlands National Park. <br />Enabling legislation for these units includes: <br />? Flaming Gorge National Recreation Area Act of 1968 (P.L. 90-540) <br />? Antiquities Act of 1906, 16 U.S.C. 431-433. The Dinosaur National Monument was <br />originally designated by President Wilson in October 1915 and was enlarged by <br />President Roosevelt in 1938. <br />Management authorities include: <br />? National Park Service Organic Act (16 U.S.C. 1-4, 22, 43) <br />? National Park Service General Authorities Act of 1970 <br />(16 U.S.C.Ia-1) <br />?
