Minimum insurance requirements will include <br />352 $1,000,000 general liability per occurrence. <br />353 <br />354 Criteria for Evaluating Proposals <br />355 T'he Governance Committee will appoint a Proposal Selection Panel that will evaluate all <br />356 proposals and select the most qualified firm. <br />357 <br />358 Principal considerations will be: <br />359 <br />360 1. The prospective contractor's understanding of the overall objective(s) of the project as <br />361 demonstrated by their management arnd technical approaches. <br />362 <br />363 2. Contractor's relevant project experience and relevant experience of the proposed project <br />364 team members. <br />365 <br />366 3. The clarity and content of the contractor's proposed tasks and timeline. <br />367 <br />368 Award Notice <br />369 After completing the evaluation of all proposals and, if deemed necessary, interviews, the <br />370 Proposal Selection Panel will select the most qualified contractor. The firm selected as most <br />371 qualified will negotiate with the ED Office to establish a fair and equitable contract. If an <br />372 agreement cannot be reached, the second gnost qualified firm will be invited to negotiate and so <br />373 on. If the Program is unable to negotiate a mutually satisfactory contract with a contractor, it <br />374 may, at its sole discretion, cancel and reissue a new RFQ. <br />375 <br />376 Program Persgective <br />377 The Governance Committee of the Program has the sole discretion and reserves the right to <br />378 reject any and all proposals received in response to this RFQ and to cancel this solicitation if it is <br />379 deemed in the best interest of the Progam to do so. Issuance of this RFQ in no way constitutes a <br />380 commitment by the Program to award a contract, or to pay contractor's costs incurred either in <br />381 the preparation of a response to his RFQ or during negotiations, if any, of a contract for services. <br />382 The Program also reserves the right to make amendments to this RFQ by giving written notice to <br />383 contractors, and to request clarification, supplements, and additions to the information provided <br />384 by a contractor. <br />385 <br />386 By submitting a proposal in response to his solicitation, contractors understand and agree that <br />387 any selection of a contractor or any decision to reject any or all responses or to establish no <br />388 contracts shall be at the sole discretion of ghe Program. To the extent authorized by law, the <br />389 contractor shall indemnify, save, and hold harmless the Nebraska Community Foundation, the <br />390 states of Colorado, Wyoming, and Nebraska, the Department of the Interior, members of the <br />391 Governance Committee, and the Executive Director's Office, their employees, employers, and <br />392 agents, against any and all claims, damages, liability, and court awards including costs, expenses, <br />6 <br />Page 9 of 10
