i <br />PRRIP - ED OFFICE DRAFT 11/03/2008 <br />353 7) Description of insurance shall be provided with the proposal. Proof of insurance will be <br />354 required before a contract is issued. Minimum insurance requirements will include <br />355 $1,000,000 general liability per occurrence. <br />356 <br />357 Criteria for Evaluating Proposals <br />358 The Governance Committee will appoint a Proposal Selection Panel that will evaluate all <br />359 proposals and accept the one that it believes to be in the best interest of the Program. Price will <br />360 not be the sole determining factor in the selection of a proposal. The Governance Committee <br />361 shall not be obligated to award a contract pursuant to this Request for Proposals and may reject <br />362 any or all proposals. <br />363 <br />364 Principal considerations will be: <br />365 <br />366 l. The prospective contractor's understanding of the overall objective(s) of the project as <br />367 demonstrated by their project understanding and technical approach. <br />368 <br />369 2. The qualifications of the contractor and relevant experience of the individual personnel <br />370 assigned to the project. <br />371 <br />372 3. The clarity and content of the contractor's scope, timeline, and budget. <br />373 <br />374 Award Notice <br />375 After completing the evaluation of all proposals and, if deemed necessary, interviews, the <br />376 Proposal Selection Panel will tentatively select the contractor that will provide the services. A <br />377 final award, however, will be contingent upon successful negotiation of a contract. If the <br />378 Program is unable to negotiate a mutually satisfactory contract with its first choice, it may, at its <br />379 sole discretion, negotiate with its secondary choices ar cancel and reissue a new RFP. <br />380 . <br />381 Program Perspective <br />382 The Governance Committee of the Program has the sole discretion and reserves the right to <br />383 reject any and all proposals received in response to this RFP and to cancel this solicitation if it is <br />384 deemed in the best interest of the Program to do so. Issuance of this RFP in no way constitutes a <br />385 commitment by the Program to award a contract, or to pay contractor's costs incurred either in <br />386 the preparation of a response to his RFP or during negotiations, if any, of a contract for services. <br />387 The Program also reserves the right to make amendments to this RFP by giving written notice to <br />388 contractors, and to request clarification, supplements, and additions to the information provided <br />389 by a contractor. <br />390 <br />391 By submitting a proposal in response to his solicitation, contractors understand and agree that <br />392 any selection of a contractor or any decision to reject any or all responses or to establish no <br />393 contracts shall be at the sole discretion of the Program. To the extent authorized by law, the <br />394 contractor shall indemnify, save, and hold harmless the Nebraska Community Foundation, the <br />395 states of Colorado, Wyoming, and Nebraska, the Department of the Interior, members of the <br />396 Governance Committee, and the Executive Director's Office, their employees, employers, and <br />Page 9 of 10
