Minimum insurance requirements will include 355 $1,000,000 general liability per occurrence. 356 357 Criteria for Evaluating Proposals 358 The Governance Committee will appoint a Proposal Selection Panel that will evaluate all 359 proposals and accept the one that it believes to be in the best interest of the Program. Price will 360 not be the sole determining factor in the selection of a proposal. The Governance Committee 361 shall not be obligated to award a contract pursuant to this Request for Proposals and may reject 362 any or all proposals. 363 364 Principal considerations will be: 365 366 l. The prospective contractor's understanding of the overall objective(s) of the project as 367 demonstrated by their project understanding and technical approach. 368 369 2. The qualifications of the contractor and relevant experience of the individual personnel 370 assigned to the project. 371 372 3. The clarity and content of the contractor's scope, timeline, and budget. 373 374 Award Notice 375 After completing the evaluation of all proposals and, if deemed necessary, interviews, the 376 Proposal Selection Panel will tentatively select the contractor that will provide the services. A 377 final award, however, will be contingent upon successful negotiation of a contract. If the 378 Program is unable to negotiate a mutually satisfactory contract with its first choice, it may, at its 379 sole discretion, negotiate with its secondary choices ar cancel and reissue a new RFP. 380 . 381 Program Perspective 382 The Governance Committee of the Program has the sole discretion and reserves the right to 383 reject any and all proposals received in response to this RFP and to cancel this solicitation if it is 384 deemed in the best interest of the Program to do so. Issuance of this RFP in no way constitutes a 385 commitment by the Program to award a contract, or to pay contractor's costs incurred either in 386 the preparation of a response to his RFP or during negotiations, if any, of a contract for services. 387 The Program also reserves the right to make amendments to this RFP by giving written notice to 388 contractors, and to request clarification, supplements, and additions to the information provided 389 by a contractor. 390 391 By submitting a proposal in response to his solicitation, contractors understand and agree that 392 any selection of a contractor or any decision to reject any or all responses or to establish no 393 contracts shall be at the sole discretion of the Program. To the extent authorized by law, the 394 contractor shall indemnify, save, and hold harmless the Nebraska Community Foundation, the 395 states of Colorado, Wyoming, and Nebraska, the Department of the Interior, members of the 396 Governance Committee, and the Executive Director's Office, their employees, employers, and Page 9 of 10
