also allow aggregated prepaid replacement of depletions in the winter to <br />reservoirs unless directed otherwise by the courts. If there is a call, however, <br />delayed or aggregated replacement can result in injury to the calling right <br />because the timing difference may result in the replacement providing water to a <br />different water right than would have received it had the replacement been done <br />on a real time basis. <br />• DWR's current policy is to no longer allow delayed aggregated replacement to <br />occur if there is a reservoir call unless it is specifically confirmed by statute or the <br />court. <br />• May require rulemaking <br />c. Storage: <br />• Encourage municipalities to construct recharge projects now in exchange <br />for use in the future for maintaining historical return flows for transferred <br />water rights. <br />iii. Financial assistance for storage projects and <br />augmentation/recharge projects <br />• Banking systems for the aquifer; where the water will come from and if it <br />can be relied on for a continuing basis <br />• Expansion of the statutes to include underground storage <br />• Short vs. long-term options <br />• Authority of State Engineer to administer <br />• Relying on water banking for pumping depletions and augmentation plans; <br />inability to know when the water hits the river; crediting of water <br />transferred from ag to municipal use; and use when the river is free. <br />iv. Financial assistance for upgrading and reconstructing <br />storage diversion structures and feeder canals to allow reservoirs to fill sooner and <br />allow senior call to come off. <br />d. Amnesty on replacement obligations for depletions resulting from pre- <br />1974 pumping (requires statutory change)
