S. WHEREAS, the Colorado General Assembly has authorized the expenditure of funds from the Species Conservation Trust Fund pursuant to HJR OZ-1038 in the amount of $1,400,000, HJR 03-1012 in the amount of $1,405,000, and SJR 04-031 in the amount of $1,489,000, which funds currently are available to meet a portion of the obligation. As the Colorado .General Assembly authorizes additional expenditures from the Species Conservation Trust Fund, the parties wi(I amend this contract~to provide those additional portions of the STATE's cost share funds. In addition, further funding in the future from al! Recovery Program participants will be required to complete this RIPRAP component of the Recovery Program as currently envisioned. NOW, THEREFORE, in consideration of the mutual and dependent covenants contained herein, the parties agree as follows: . 1. PURPOSE AND OBJECTIVES The purpose of this Contract is to provide a portion of the STATE'S cost share funds required by Public Law 106-392 for the .Recovery Program directly to the RIVER DISTRICT for- use by the RIVER DISTRICT in construction of the Elkhead Reservoir Enlargement pursuant to the RIPRAP and resolution of the Recovery Program dated December 9, 2002. This Contract will facilitate and. contribute to the accomplishment of that endangered fish recovery activity pursuant to the Recavery Program in an efficient and timely manner. - 2. AUTHORITIES This contract is entered into pursuant to Public Law 106-392, an Act to authorize the Bureau of Reclamation to -provide cost sharing for. the endangered fish recovery implementation programs for the Upper Colorado and San Juan River basins. State authority is found in C.R.S. 2433=111 creating the Species Conservation Trust Fund, one of the purposes of which is to fund State participation in Recovery Programs designed to meet obligations arising -under the federal Endangered Species Act of 1973. The Species Conservation Trust Fund is managed by the Colorado General Assembly and the expenditure of monies from the Species Conservation Trust Fund is authorized by Joint Resolution annually -based on recommends#ions from the DNR. The RIVER DISTRICT's -authority to enter- into this contract is found -in sections 37-46-101-, et seq. C.R.S., and Article 45.1 of Title 37, C.R.S. 3. SPECIFIC OBLIGATIONS OF THE PARTIES A. Performance of PROJECT. The CONTRACTOR shall construct -the PROJECT in accordance with- -the -PROJECT plans and specifications -approved by the State Engineer. - ~ - 4
