<br />N. WHEREAS, the express purpose ofi this contract is to allow the STATE to .provide its
<br />Recovery Program cos# share furyds required by Public Law 106-392 directly to the
<br />RIVER DISTRICT for-use in implementing the Elkhead Reservoir Enlargement
<br />capita! construction project identified- by the Recovery Program in the RIPRAP and
<br />to receive appropriate -cost share credit from the Recovery P_ rogram for this
<br />expenditure. -
<br />O. WHEREAS; this contract is part of a series of agreements required to implement the
<br />Elkhead Reservoir Enlargement that includes, among other agreements a Grant
<br />Agreement between U.S. Department of Interior agencies and the RIVER DISTRICT
<br />{"Grant Agreement}, an Agreement Concerning Elkhead Reservoir Enlargement to
<br />Facilitate Recovery of Endangered Fish Species- in the Yampa River Basin befinreen
<br />U.S.- Department of Interior agencies and the RIVER -DISTRICT ("Reservoir
<br />Enlargement Agreement"), and an Acquisition Agreement between the Colorado
<br />Water Conservation -Board, the RIVER DISTRICT, U.S. Bureau of Reclamation, and
<br />the U.S. Fish and Wildlife Service ("Acquisition Agreement"). All of the agreements
<br />are specifically listed in recital M of the Acquis~ion Agreement. - .
<br />P. WHEREAS, the cost for implementing both the Recovery Program and the San Juan
<br />Recovery Implementation Prflgrarn (SJRIP} pursuant to Public Law 106-392 is
<br />established at $100 million through fiederal FY 2007. The states' Est -share is $17
<br />million and Colorado's cost share contribution -over this period is- $9,146,000
<br />{$8,065,000 -for the Recovery Program and $1,081,000 for the SJRIP). The
<br />following table shows the states' cost-share:

<br />Q. WHEREAS, the Recovery Program -has allocated up to $9,159,082_ for the Elkhead
<br />Reservoir Enlargement.. -
<br />R. -WHEREAS, the STATE wishes -to -contribute a portion of its required cost share
<br />funds directly to-the RIVER -DISTRICT for the construction of the Elkhead Reservoir
<br />enlargement -with the agreement of the Recovery Program participants that such
<br />funds are part of the STATE'S cost share contribution to -the Recovery Program
<br />required by Public Law 106-392, The-Recovery Program Implementation Committee
<br />adopted a resolution on March 8, 2004, -incorporated herein by reference; confirming
<br />that agrees Went. - -
