~ ~ <br />Exhibit A <br />SC~~PE OF SERVICES <br />AS-NEEDED BOSLEY W~~SH FLOOD PROTECTION PROJECT <br />MESA t~OUN'~'Y, COLORADO <br />Colorado W,~ter Conservation Board <br />DE:CEM~ER 2005 <br />CONSVLTANT <br />This Scope of Services (Scope) shall be used for the selection of the consulting engineer (Consultant) for <br />the performance of the Bosiey Wash Flood Pr~~tection Design Project. The Colorado Water Conservation <br />Board (CWCB) is the project Sponsor. The mziximum State funding to the Consu{tant for this Scope of <br />Services is 25 000. The Grand Junction Drainage District (GJDD) is the co-sponsor and shall contribute <br />an additional 25 000. <br />SUMMARY OF REQUESTED WORK <br />The Consultant shall perform existing data project engineering reviews, fieldwork, data collection, <br />preliminary project designs, cost estimates, re~riew meetings, prepare project right-of-way parcel maps and <br />descriptions, contract documents, project reports and other tasks necessary to complete Bosley Wash <br />Detention Dam project final design reports for bidding the project. This Scope may be amended during the <br />CWCB-Consultant final contract negotiations ~ind shall become valid with an executed contract. <br />AUTHORITY <br />According to Section 37-60-106(1)(c) of the Cc>lorado Revised Statutes, the Colorado Water Conservation <br />Board has the power and dury: <br />"... to devise and formulate methods, rrieans and plans for bringing about the greater utilization of <br />the waters of the state and the prevention of flood damages therefrom... " <br />According to Section 37-31-101 of the Colorado Revised Statutes, the Grand Junction Drainage District <br />has the power and duty for: <br />"...construction of a suitable drainage works for the protection of urban and rural property within <br />said district wil4 promote the health, con~fort, safety, convenience, and welfare of all the people <br />residing or owning property within said ~district and that the construction of said drainage works is <br />therefore a governmental function confe;rring a general benefit upon all of the people residing or <br />owning property within said district." an~j <br />According to Section 37-31-123 of the Colorad~~ Revised Statutes, the Grand Junction Drainage District <br />has the power and duty: <br />"...to enter into a contract upon such terms as the board may regard as equitable, with any <br />individual, partnership, corporation, or governmental entity or an irrigation or drainage district <br />organized under the laws of this state oi~ with more than one or with all of said parties, for the <br />making of any surveys, plans, and specifications for a proposed drainage ditch, system, or works, <br />or for the construction in whole or in part of such drainage ditch, system, or works, or for the joint <br />use of any drainage ditch or drainage facilities" <br />
