Re nolds 1 <br />SLW Ranch Com an , LLC 2 <br />Travis Heare 2 <br />TOTAL 17 <br />Each member of the OAC has entered into a Well Augmentation Agreement and Covenant which <br />provides the OAC authority to set annual assessments to be paid by the members; the power to curtail <br />pumping of wells owned by members that fail to pay their assessments; the power to place a lien on <br />members Ogilvy Ditch shares and land property owned by members that fail to pay their <br />assessments. The OAC articles of incorporation and by-laws are included in Appendices A and B, <br />respectively. A sample copy of the Augmentation Agreement and Covenant is included in Appendix <br />C. Members of the OAC are also shareholders in the OILC, owning 208 shares out of 360 <br />outstanding shares in the OILC. <br />3.0 PROJECT SERVICE AREA <br />The OILC owns and operates the Ogilvy Ditch and Seeley Lake for the benefit of the shareholders of <br />OILC by providing direct flow and storage of irrigation water. The Ogilvy Ditch diverts from the <br />Cache La Poudre River east of Greeley and delivers water through a 15-mile ditch system to a <br />service area of approximately 3,600 acres located north of Kersey, Colorado. Figure 1 shows the <br />general service area of the Ogilvy Ditch and Figure 2 shows that location of structures.
