Water Supply Reserve Account - Grant Application Form <br />Fonn Revised May 2007 <br />2. The water activity is consistent with Section 37-75-102 Colorado Revised Statutes. The <br />requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines. <br />Projects shall conform to the requirements/language of the above Statute. Projects delivered with <br />funds provided as part of this application have existing or will file for recharge rights according to the <br />laws and statutes of Colorado. Water rights for DT Ranch and Fender are currently being finalized and <br />should be filed with District One Water Court before the fiinds for the project are allocated. The <br />Heyborne project water rights have been filed as part of Lower South Platte Water Conservancy <br />District's (LSPWCD) decree for augmentation water under case no 08CW24. The projects will be able <br />to operate via a temporary substitute water supply plan filed immediately following the water court filing. <br />Any other existing water rights to be protected through the easement will be discussed in detail later in the <br />proposal. The easement simply protects existing water rights and alloys for flexibility in management of the water <br />right in future rears. <br />3. The water activity undenvent an evaluation and approval process and was approved by the Basin <br />Roundtable (BRT) and the application includes a description of the results of the BRTs evaluation <br />and approval of the activity. At a minimum, the description must include the level of agreement <br />reached by the roundtable, including any minority opinion(s) if there was not general agreement for <br />the activity. The description must also include reasons why general agreement was not reached (if it <br />was not), including who opposed the activity and why they opposed it. Note- If this information is <br />included in the letter from the roundtable chair simply reference that letter. <br />This information will be provided in a letter following a South Platte Roundtable meeting on July <br />8t'2008. <br />4. The water activity meets the provisions of Section 37-75-104(2). Colorado Revised Statutes. The <br />requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines. <br />Given the status of many requirements under this threshold, the project proponent has exceeded most <br />expectations. Although many of the requirements outlined in this statute are being pursued by each <br />roundtable, none of them are complete. <br />5
