The water activity meets the eligibility requirements outlined in Part 2 of the Criteria and Guidelines. <br />The water activity meets the eligibility requirements outline in Part 2 of the Criteria and <br />Guideline. As a private non-government organization, Ducks Unlimited is eligible to apply for the <br />SB-179 grant funds. The grant provided by SB-179 will be used to deliver capital construction <br />projects of a structural nature by purchasing materials and equipment, contracting construction <br />work, etc. Funds will also be used to purchase conservation easements on three properties to protect <br />non-consumptive use aspects of subject lands including environmental, recreational, and cultural. <br />Our conservation easements also provide perpetual protection of water rights associated with the <br />lands assuring the water right will be available for agriculture, wildlife, municipal, and industrial <br />needs via direct application of water to the land and through water recharge credits developed as <br />part of the project. <br />Most projects outlined in the application are already approved for NEPA Section 7 through the <br />SPWRAP. However, Section 404 permits of the Clean Water Act will need to be attained. <br />4
