Describe how the water activity meets these Threshold Criteria. <br />The water activity meets the eligibility requirements outlined in Part 2 of the Criteria and <br />Guidelines. <br />The project is eligible as a Structural Water Project. The Town of Fowler is eligible as a <br />Public (Government) Municipality. <br />2. The water activity is consistent with Section 37-75-102 Colorado Revised Statutes. The <br />requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines. <br />Fowler is currently operating under CWPDA's Arkansas River Replacement Plan to replace <br />its out of priority- depletions. The Town has seven more rears under this plan before it must <br />develop its own Augmentation Plan and have it adjudicated in the Water Court. <br />There are two principal sources for the Town's replacement water, The Oxford Fanners <br />Ditch Shares and Frying Pan Arkansas Project Water. The Town controls 8.6 shares of the <br />Oxford and has 481.29 acre feet of Project Water stored in Pueblo Reservoir. To date, <br />Fowler has never had a problem meeting its replacement obligations of about 475 ac.- <br />ft./near. <br />The water activity undeiNvent an evaluation and approval process and was approved by the <br />Basin Roundtable (BRT) and the application includes a description of the results of the <br />BRTs evaluation and approval of the activity. At a minimum, the description must include <br />the level of agreement reached by the roundtable, including any minority- opinion(s) if there <br />was not general agreement for the activity. The description must also include reasons why- <br />general agreement was not reached (if it was not), including who opposed the activity- and <br />wh-,they opposed it. Note- If this information is included in the letter from the roundtable <br />chair simply reference that letter. <br />We are tentatively scheduled for the March, 2008 Arkansas BRT Needs Assessment <br />Committee Meeting. <br />4. The water activity meets the provisions of Section 37-75-104(2), Colorado Revised Statutes. <br />The requirements/language from the statute is provided in Part 3 of the Criteria and <br />Guidelines. <br />For Applications that include a request for funds from the Statewide Account, describe how the <br />water activity meets the Evaluation Criteria. See Part 3 of Criteria and Guidelines. <br />l ollaboration and <br />The installation of the proposed "Backfeed" line, is the first step in the overall development of the <br />Town of Fowler's water resources. Presently, the main issue of concern are the elevated selenium <br />levels associated with the North Springs, and more particularly, the issue of a sole source which <br />would serve the entire community with the same quality of potable water. <br />Initially, the benefactors of the Installation of the "Backfeed" line shall be the 39 customers who <br />are not receiving blended potable water from the storage tanks.
