• Please provide the CWCB copies of the previous studies that are listed in the <br />application. <br />Staff Recommendation <br />Due to the difficulty in determining whether this proj ect meets the eligibility requirement <br />#2 (that the project must protect property and water rights), staff recommends <br />conditional approval of this grant request. Specifically, prior to final approval, the <br />applicant shall conduct a legal analysis involving antitrust issues as described in Task E <br />of the scope of work and a legal analysis of how this project protects property and water <br />rights for Super Ditch participants and non-participants. Due to the policy implications <br />involved, staff also recommends that the applicant present this legal analysis to the <br />CWCB at either the July or September 2008 meeting for their consideration and approval. <br />Staff recommends funding up to $480,371 for the Lower Arkansas Valley Super <br />Ditch Company grant request contingent on resolution of the items in the <br />issues/additional needs section. It should be noted that past costs can not be <br />reimbursed. All products, data and information developed as a result of this grant <br />must be provided to CWCB in hard copy and electronic format as part of the project <br />ocumentatlon. <br />
