Headgate 135 Lateral, Inc. Pipeline Projeet

Introduction

The Headgate 135 Lateral, Incorporation a Colorado non-profit corporation
manages the Lateral 135 for the benefit of its shareholders who receive water
under the lateral. Irrigation water is diverted from the Colorado River into
the Grand Valley Canal and carried to the headgate of the Lateral135.The
lateral is approximately 2.5 miles in length. The Lateral proposes to upgrade
the headgate and install 4800 feet of pipeline from the headgate to Gunnison
Avenue.

Projeet Sponsor

Headgate 135 Lateral, Incorporation, has been incorporated in the State of
Colorado since September 19, 1988. There are approximately 100
shareholders in the Corporation. The Corporation has the power to assess the
shareholders for operations, maintenance and administrative costs. Each
shareholder currently pays an annual $ 50.00 assessment. Subdivision users
each pay an additional $15.00 for irrigation water. Headgate 135 Lateral, Inc.
is governed by a board of five directors "currently there is a vacancy".
Traditionally, the Board of Directors meets and sets it's annual assessment at
it's March meeting. The Headgate 135 Lateral, Inc. conveys a total of217
shares to its shareholders in the Grand Valley Irrigation Company: most of
the water shares are owned by individual shareholders. However 66 shares
have been pooled by shareholders in a trust agreement to reduce the cost in
the canal usage. The Articles of Incorporation, and By-laws are included as
Appendix A.

Projeet Service Area and Facilities

The Lateral is used for irrigating several small farms, an Elementary School
and several subdivisions, and individual homeowners. A map of the proposed
project is contained in the back pocket.
S
