<br />Under these circumstances, we are requesting the following clarifications: <br />. Is there a procedure under which exceptions can be made to the LUDP to allow <br />tor the replacement of inundated facilities at elevations lower than the lO-year <br />flood pool if it can be demonstrated that public safety and other considerations <br />are not unreasonably compromised? In this regard, it should be noted that the <br />existing buildings located adjacent to the current pool elevation and within the <br />lO-year flood elevation at Chatfield State Park, constructed by the Corps of <br />Engineers in the late] 970's, have been inundated on at least three occasions <br />without sustaining damage or creating hazards or olher public safety concerns. <br />Relocated buildings could be constructed using design standards similar to <br />existing buildings, and that meet current construction codes. <br />. If it is possible to seek an exception to the LUDP at Chatfield State Park, is there <br />any further guidance on how to go about obtaining such an exception and the <br />planning and design considerations that must be met? <br /> <br />If the determination is made that the relocation of all buildings must comply with the LUDP <br />policy, the Chatfield Reallocation Project recreation mitigation plan will need additional time <br />and expense to analyze innovative and potentially expensive solutions in order to keep the <br />recreational experience for our visitors consistent with the current conditions at Chatfield State <br />Park. <br /> <br />Your consideration of these items in a timely manner is very much appreciated.
