<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />3.1.2 Selected Alternative And Proposed Project <br /> <br />3.1.2.1 General Description <br /> <br />The proposed project is the purchase of an undivided one-third interest in the Pine River <br />Weminuche Pass Ditch (AKA Fuch' s Ditch) water rights which total 18cfs. See Table 3- <br />1 below. John A. Weaver, 557 Crestview Drive, Village Brook, Livingston, Texas <br />77351, currently owns one-third ('i'3) of the water rights which he has offered to sell to the <br />District. The Pine River Weminuche Ditch diverts water from the Rio Los Pinos, a <br />tributary of the San Juan River in Hindsdale County, Water Division NO.7 and delivers it <br />to the Rio Grande Basin in Water Division NO.3. The District currently owns one-half <br />(1/2) or 9cfs interest in the Ditch. This transmountain ditch crosses the Continental <br />Divide near the headwaters of the Rio Grande within the Weminuche Wilderness is <br />shown in Figure 3-1. <br /> <br />The additional one-third (13) or 6 cfs of the water rights the District intends to purchase <br />with a loan from the CWCB will be added to the District's Augmentation Program <br />through a new augmentation plan decree from the Water Division 3 Water Court. The <br />decree will change the use of the water from irrigation uses in the Rio Grande Basin, to <br />uses consistent with the augmentation needs of the District's Program and allow use of <br />the water at locations and quantities described in the plan. The decree will be very <br />similar to the District's augmentation decree approved in Water Court Case No. <br />94CW62, a copy of which is included in Appendix A for reference. <br /> <br />The District operates its Augmentation Program by selling water right certificates to <br />individuals or entities desiring a depletive water right for domestic or commercial <br />purposes. The water right certificate is typically used to obtain a well permit or other <br />authorized water use that consumptively uses water tributary to the Rio Grande. <br /> <br />3.1.2.2 Description and Yield of Water Rights <br /> <br />The water rights diverted from the Rio Los Pinos were adjudicated by the District Court, <br />La Plata County, Colorado, Case No. 1248-B, on March 7, 1966 for the irrigation of <br />lands in Rio Grande County.
