<br />Feasibility Study <br />Fulton Irrigation Ditch Company <br />Spillway Repair Project <br /> <br />Introduction <br /> <br />The Fulton Irrigation Ditch Company ("Fulton"), located in Adams County, <br />operates the Fulton Ditch for the benefit of the shareholders by providing direct flow <br />irrigation water. The ditch diverts from the South Platte, at approximately 100th Avenue, <br />and water deliveries are made through the Company's ditch to the approximately 37,628- <br />acre service area. Late in the 2003 irrigation season a leak in the Fulton spillway was <br />discovered, which if not repaired, will lead to a failure of the entire river diversion <br />structure. <br /> <br />Project Sponsor <br /> <br />The Fulton is a mutual ditch company and a non-profit corporation registered in <br />the State of Colorado. There are 220 shareholders and 7,185 shares of stock. The Fulton <br />has the power to set annual assessments to be paid by the shareholders, the power to cut <br />off water deliveries to shareholders that fail to pay their assessments, and the power to <br />offer stock for sale to pay back assessments. The Fulton Articles of Incorporation and By <br />Laws were included with its previously submitted application. <br /> <br />Project Service Area and Facilities <br /> <br />The Fulton provides irrigation water to approximately 37 ,628-acre service area in <br />Adams County. The headworks for the Fulton Ditch are located in the NE lf4 SE lf4 <br />Section 17, T25, R67W, 6th P.M., Adams County, at a point approximately 2,815 feet <br />south and 145 feet West of the Northeast corner of said Section 17 at approximately 100th <br />Avenue and the South Platte twenty-two (22) miles south of Brighton, and extends <br />Northerly approximately 39 miles. Irrigated acreage within the service area is primarily <br />used for the irrigation of vegetable and other crops though about 25% of the shares in the <br />ditch are owned by municipalities and other water providers who augment those shares. <br />A map of the Fulton Ditch and photos of the existing diversion attached to this report. <br /> <br />Hydrology and Water Rights <br /> <br />The source of water for the Company is direct flow water rights out of the South <br />Platte River. The water rights diverted at the Fulton headgate consist of three (3) rights <br />with dates of appropriation May 1,1865, July 8,1876 and November 5,1879 and totaling <br />204.18 cfs. The Fulton owns all of these rights totaling 204.18 cfs. Records ofthe State <br />Engineer's Office indicate that total average annual diversions are 30,666 acre-feet, based <br />on record years 1999 through 2003, and that the maximum diversion rate was 32,656 cfs <br />for record year 2000.
