The source of the water is: <br /> <br />Cub Creek, tributary to the South Platte River. <br /> <br />4. <br />claimed. <br /> <br />Legal description of the stream segment through whiclian instream flow is <br /> <br />The natural stream channel from the headwaters in the vicinity of <br />latitude 39032'54"N and longitude 105023'25"W as the upstream <br />terminus and extending to Evergreen Lake at latitude 39037'55"N <br />and longitude 1 05019' 19"W as the downstream terminus, being a <br />distance of approximately 8.1 miles. This segment can be located <br />on the Meridian Hill, Conifer and Evergreen U.S.G.S. quadrangles <br />and is depicted on Exhibit A. <br /> <br />For the stream segments in an unsurveyed area, the Division <br />Engineer has determined for administrative purposes that the <br />approximate legal description of the instream flow termini as <br />protracted from U.S.G.S. and/or U.S.F.S..mapping is as follows: <br />upstream terminus in the NE/4, NE/4, Sec. 12, T6S, R72W, 6th <br />P.M., 750 feet West and 400 feet South of the Northeast comer; <br />downstream terminus in the SW/4, NE/4, Sec. 10, T5S, R71W, 6th <br />P.M., 2,300 feet West and 2,300 feet South of the Northeast corner. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 3, 1994. <br /> <br />7. The water was first applied to the above beneficial use on November 3, 1994, by <br />action of the Colorado Water Conservation Board under the provision ofC.R.S. 99 37-92-102(3), <br />37-92-103(3),(4),(10). <br /> <br />2 <br />
